AGREEMENT
BETWEEN

GOVERNMENT OF THE REPUBLIC OF INDONESIA
AND
THE
GOVERNMENT OF THE REPUBLIC OF INDIA
FOR
THE
AVOIDANCE OF DOUBLE TAXATION AND THE PREVENTION OF
FISCAL
EVASION WITH RESPECT TO TAXES ON INCOME
The Government of the Republic of
Indonesia and the Government of the Republic of India, [MODIFIED by paragraph 1 of Article 6 of the MLI] [desiring to
conclude an Agreement for the avoidance of double taxation and the prevention
of fiscal evasion with respect to taxes on income]

The following paragraph 1 of
Article 6 of the MLI is included in addition to the text referring to an
intent to eliminate double taxation in the preamble of this Agreement:
ARTICLE
6 OF THE MLI  PURPOSE OF A COVERED TAX AGREEMENT
Intending to eliminate double
taxation with respect to the taxes covered by the Agreement without creating
opportunities for non-taxation or reduced taxation through tax evasion or
avoidance (including through treaty-shopping arrangements aimed at obtaining
reliefs provided in the Agreement for the indirect benefit of residents of
third jurisdictions), |
and with a view to promoting
economic cooperation between the two countries.
have agreed as follows:
CHAPTER
I
SCOPE
OF THE AGREEMENT
|
Article 1 |
This Agreement shall apply to
persons who are residents of one or both of the Contracting States.
|
The following paragraph 1 of
Article 11 of the MLI applies and supersedes the provisions of this
Agreement:
ARTICLE
11 OF THE MLI  APPLICATION OF TAX AGREEMENTS TO RESTRICT
A PARTYS RIGHT TO TAX ITS OWN RESIDENTS
The Agreement shall not affect
the taxation by a Contracting State of its residents, except with respect to
the benefits granted under paragraph 2 of Article 9, Article 19, Article 20,
Article 21, Article 23, Article 25, Article 26, and Article 29 of the
Agreement |

Article 2 |
1. This Agreement shall apply to taxes on income imposed on
behalf of a Contracting State or of its political subdivisions or local
authorities. Irrespective of the manner in which they are levied.
2. There shall be regarded as taxes on income all taxes imposed
on total income, or on elements of income, including taxes on gains from the
alienation of movable or immovable property and taxes on the totals amounts of
wages or salaries paid by enterprises.
3 The existing taxes to which the Agreement shall apply are in
particular :
(a)
in the case of the Republic of
Indonesia:
the
income tax:
(hereinafter
referred to as "Indonesian tax");
(b)
in the case of the Republic of India:
the
income tax, including any surcharge thereon;
(hereinafter
referred to as "Indian tax").
4. The Agreement shall also apply to any identical or
substantially similar taxes that are imposed after the date of signature of the
Agreement in addition to, or in place of, the existing taxes The competent
authorities of the Contracting States shall notify each other of any
significant changes that have been made in their respective taxation laws.
CHAPTER
II
DEFINITIONS
|
Article 3 |
1. For the purposes of this Agreement, unless the context
otherwise requires:
(a) the term "Republic of Indonesia"
means the territory of the Republic of Indonesia as defined in its laws, and
parts of the continental shelf, exclusive economic zone and adjacent seas over
which the Republic of Indonesia has sovereignty, sovereign rights or
jurisdiction in accordance with the United Nations Convention on the Law of the
Sea 1982;
(b) the term "India" means the
territory of India and includes the territorial sea and airspace above it, as
well as any other maritime zone in which India has sovereign rights, other
rights and jurisdiction, according to the Indian law and in accordance with
international law, including the United Nations Convention on the Law of the
Sea 1982;
(c) the terms "a Contracting State"
and "the other Contracting State" mean the Republic of Indonesia or
the Republic of India as the context requires;
(d) the term "person" includes an
individual, a company, a body of persons and any other entity which is treated
as a taxable unit under the taxation laws in force in the respective
Contracting States;
(e) the term "company" means any body
corporate or any entity that is treated as 3 body corporate for tax purposes;
(f) the term "enterprise" applies to the carrying on of any business;
(g) the terms "’enterprise of a Contracting
State" and "enterprise of the other Contracting State" mean
respectively an enterprise carried on by a resident of a Contracting State and
an enterprise carried on by a resident of the other Contracting State;
(h) the term "international traffic"
means any transport by a ship or aircraft operated by an enterprise of a
Contracting State, except when the ship or aircraft is operated solely between
places in the other Contracting State:
(i) the term "national" means:
(1) any individual possessing the nationality
of a Contracting State; and
(2) any legal person, partnership or
association deriving its status as such from the laws in force in a Contracting
State;
(j)
the term "competent
authority" means:
(1) in the case of the Republic of Indonesia,
the Minister of Finance or his authorised representative;
(2) in the case of the Republic of India, the
Finance Minister or his authorised representative;
(k) the term "tax" means Indonesian
or Indian tax. as the context requires, but shall not include any amount which
is payable in respect of any default or omission in relation to the taxes to
which this Agreement applies or which represents a penally or fine imposed
relating to those taxes;
2. As regards the application of the Agreement at any time by 3
Contracting State, any term not defined therein shall, unless the context
otherwise requires, have the meaning that it has at that time under the law of
that State for the purposes of the taxes to which the Agreement applies, any
meaning under the applicable tax laws of that State prevailing over a meaning
given to the term under other laws of that State.

Article 4 |
1. For the purposes of this Agreement, the term "resident of
a Contracting State" means any person who, under the laws of that State,
is liable to tax therein by reason of his domicile, residence, place of
management, place of incorporation, or any other criterion of a similar nature,
and also includes that state and any political subdivision or local authority
thereof. This term, however, does not include any person who is liable to lax
in that State in respect only of income from sources in that State.
2. Where by reason of the provisions of paragraph 1 an individual
is a resident of both Contracting States, then his status shall be determined
as follows:
(a) he shall be deemed to be a resident only of the State in which
he has a permanent homo available to him, if he has a permanent home available
to him in both States, he shall be deemed to be a resident only of the State
with which his personal and economic relations are closer (centre of vital
interests);
(b) if the State in which he has his centre of vital interests
cannot be determined, or if he has not a permanent home available to him in
either State, he shall be deemed to be a resident only of the State in which he
has an habitual abode;
(c) if he has an habitual abode in both States or in neither of
them, he shall be deemed to be a resident only of the State of which he is a
national.
(d) if his residential status cannot he determined by reason of subparagraphs
(a) to (c) in that sequence, the competent authorities of the Contracting
States shall endeavor to settle the question by mutual agreement;
3. [REPLACED by paragraph
1 of Article 4 and subparagraph e) of paragraph 3 of Article 4 of the MLI]
[Where by reason of the provisions of paragraph 1 a person other than an
individual is a resident of both Contracting States, then it shall be deemed to
be a resident only of the State in which its place of effective management is
situated. If the State in which its place of effective management is situated
cannot be determined, then the competent authorities of the Contracting States
shall endeavor to settle the question by mutual agreement.]
|
The following paragraph 1 of
Article 4 and subparagraph e) of paragraph 3 of Article 4 of the MLI replaces
paragraph 3 of Article 4 of this Agreement:
ARTICLE
4 OF THE MLI - DUAL RESIDENT ENTITIES
Where by reason of the
provisions of the Agreement a person other than an individual is a resident
of both Contracting States, the competent authorities of the Contracting
States shall endeavour to determine by mutual agreement the Contracting State
of which such person shall be deemed to be a resident for the purposes of the
Agreement, having regard to its place of effective management, the place
where it is incorporated or otherwise constituted and any other relevant
factors. In the absence of such agreement, such person shall not be entitled
to any relief or exemption from tax provided by the Agreement. |

Article 5 |
1. For the purposes of this Agreement, the term "permanent
establishment" means a fixed place of business through which the business
of an enterprise is wholly or partly carried on.
2. The term "permanent establishment" includes
especially :
(a) a place of management;
(b) a branch;
(c) an office;
(d) a factory;
(e) a workshop;
(f) a warehouse in relation to a person providing storage
facilities for others;
(g) premises as sales outlet;
(h) farm or other place where agricultural, forestry, plantation or
related activities are carried on; and.
(i) a mine, an oil or gas well, a quarry or any other place of
extraction of natural resources.
3. The term "permanent establishment" also encompasses:
(a) [MODIFIED by paragraph 1
of Article 14 of the MLI] [a building site or a construction or assembly or
installation project or supervisory activities in connection therewith, but
only if such site, project or activities last for a period of more than 183
days;]
(b) a drilling rig or working ship used for exploration or
exploitation of natural resources, but only if so used for a period more than
183 days;
(c) the furnishing of services, including consultancy services, by
an enterprise through employees or other personnel engaged by the enterprise
for such purpose, but only if activities of that nature continue (for the same
or a connected project) within a Contracting State for a period or periods
aggregating more than 91 days within any twelve month period.
|
The following paragraph 1 of
Article 14 of the MLI applies and supersedes the provisions of this
Agreement:
ARTICLE
14 OF THE MLI  SPLITTING-UP OF CONTRACTS
For the sole purpose of
determining whether the 183 days referred to in paragraph 3 of Article 5 of
the Agreement has been exceeded: a) where an enterprise of a Contracting State carries on
activities in the other Contracting State at a place that constitutes a
building site or a construction or assembly or installation project or
supervisory activities in connection therewith, and these activities are
carried on during one or more periods of time that, in the aggregate, exceed
30 days without exceeding the period or periods referred to in paragraph 3 of
Article 5 of the Agreement; and b) where connected activities are carried on in that other
Contracting State at in connection with the same a building site or a
construction or assembly or installation project or supervisory activities in
connection therewith during different periods of time, each exceeding 30
days, by one or more enterprises closely related to the first-mentioned
enterprise, these different periods of time
shall be added to the aggregate period of time during which the first
mentioned enterprise has carried on activities at that a building site or a
construction or assembly or installation project or supervisory activities in
connection therewith. |
4. [MODIFIED by paragraph
2 of Article 13 of the MLI] [Notwithstanding the preceding provisions of
this article, the term "permanent establishment" shall be deemed not
to include:
(a) the use of facilities solely for the purpose of storage or
display of goods or merchandise belonging to the enterprise;
(b) the maintenance of a stock of goods or merchandise belonging to
the enterprise solely for the purpose of storage or display;
(c) the maintenance of a stock of goods or merchandise belonging to
the enterprise solely for the purpose of processing by another enterprise;
(d) the maintenance of a fixed place of business solely for the
purpose of purchasing goods or merchandise, or of collecting information, for
the enterprise;
(e) the maintenance of fixed place of business solely for the
purpose of carrying on, for the enterprise, any other activity of a preparatory
or auxiliary character;
(f) the maintenance of a fixed place of business solely for any
combination of activities mentioned in sub-paragraphs (a) to (e), provided That
the overall activity of the fixed place of business resulting from this
combination is of a preparatory or auxiliary character.]

The following paragraph 2 of
Article 13 of the MLI applies to paragraph 4 of Article 5 of this Agreement:
ARTICLE
13 OF THE MLI - ARTIFICIAL AVOIDANCE OF PERMANENT ESTABLISHMENT
STATUS THROUGH THE SPECIFIC ACTIVITY EXEMPTIONS (Option
A)
Notwithstanding Article 5 of
the Agreement, the term "permanent establishment" shall be deemed
not to include: a) the activities specifically listed in paragraph 4 of Article
5 of the Agreement as activities |
|
deemed not to constitute a permanent establishment,
whether or not that exception from permanent establishment status is
contingent on the activity being of a preparatory or auxiliary character; b) the maintenance of a fixed place of business solely for the
purpose of carrying on, for the enterprise, any activity not described in
subparagraph a); c) the maintenance of a fixed place of business solely for any
combination of activities mentioned in subparagraphs a) and b), provided that such activity or,
in the case of subparagraph c), the overall activity of the fixed place of
business, is of a preparatory or auxiliary character.
The following paragraph 4 of
Article 13 of the MLI applies to paragraph 4 of Article 5 of this Agreement
(as modified by paragraph 2 of Article 13 of the MLI):
ARTICLE
13 OF THE MLI - ARTIFICIAL AVOIDANCE OF PERMANENT ESTABLISHMENT
STATUS THROUGH THE SPECIFIC ACTIVITY EXEMPTIONS
Article 5 of this Agreement (as
modified by paragraph 2 of Article 13 of the MLI) shall not apply to a fixed
place of business that is used or maintained by an enterprise if the same
enterprise or a closely related enterprise carries on business activities at
the same place or at another place in the same Contracting State and: a) that place or other place constitutes a permanent
establishment for the enterprise or the closely related enterprise under the
provisions of Article 5 of the Agreement; or b) the overall activity resulting from the combination of the
activities carried on by the two enterprises at the same place, or by the
same enterprise or closely related enterprises at the two places, is not of a
preparatory or auxiliary character, provided that the business
activities carried on by the two enterprises at the same place, or by the
same enterprise or closely related enterprises at the two places, constitute
complementary functions that are part of a cohesive business operation. |
5. Notwithstanding the provisions of paragraphs I and 2, where a
person- other than an agent of an independent status to whom paragraph 7
applies - is acting in a Contracting State on behalf of an enterprise of the
other Contracting State, that enterprise shall be deemed to have a permanent
establishment in the first mentioned Contracting State in respect of any
activities which that person undertakes for the enterprise, if such a person:
(a)
[REPLACED
by paragraph 1 of Article 12 of the MLI] [has, and habitually exercises, in
that State an authority to conclude contracts in the name of the enterprise,
unless the activities of such person are limited to those mentioned in
paragraph 4 which, if exercised through a fixed place of business, would not
make this fixed place of business a permanent establishment under the
provisions of that paragraph]; or
|
The following paragraph 1 of
Article 12 of the MLI replaces subparagraph (a) of paragraph 5 of Article 5
of this Agreement:
ARTICLE
12 OF THE MLI - ARTIFICIAL AVOIDANCE OF PERMANENT ESTABLISHMENT
STATUS THROUGH COMMISSIONNAIRE ARRANGEMENTS AND
SIMILAR STRATEGIES
Notwithstanding Article 5 of
the Agreement, but subject to paragraph 2 of Article 12 of the MLI, where a
person is acting in a Contracting State on behalf of an enterprise and, in
doing so, habitually concludes contracts, or habitually plays the principal
role leading to the conclusion of contracts that are routinely concluded
without material modification by the enterprise, and these contracts are: a) in the name of the enterprise; or b) for the transfer of the ownership of, or for the granting of
the right to use, property owned by that enterprise or that the enterprise
has the right to use; or c) for the provision of services by that enterprise, that enterprise shall be deemed
to have a permanent establishment in that Contracting State in respect of any
activities which that person undertakes for the enterprise unless these
activities, if they were exercised by the enterprise through a fixed place of
business of that enterprise situated in that Contracting State, would not
cause that fixed place of business to be deemed to constitute a permanent
establishment under the definition of permanent establishment included in the
provisions of Article 5 of the Agreement. |
(b) has no such authority, but habitually
maintains in the first-mentioned State a stock of goods or merchandise from
which he regularly delivers goods or merchandise on behalf of the enterprise.
(c) habitually secures orders in the
first-mentioned State, wholly or almost wholly for the enterprise itself
6. Notwithstanding the preceding provisions of this Article, an
insurance enterprise of a Contracting State shall, except in regard to
re-insurance, be deemed to have a permanent establishment in the other
Contracting State if it collects premiums in the territory of that other State
or insures risks situated therein through a person other than an agent of an
independent status to whom paragraph 7 applies.
7. [REPLACED by paragraph
2 of Article 12 of the MLI] [An enterprise of a Contracting State shall not
be deemed to have a permanent establishment in the other Contracting State
merely because it carries on business in that other Contracting State through a
broker, general commission agent or any other agent of an independent status,
provided that such persons are acting in the ordinary course of their business.
However, when the activities of such an agent are devoted wholly or almost
wholly on behalf of that enterprise, he will not be considered an agent of an
independent status within the meaning of this paragraph.
|
The following paragraph 2 of
Article 12 of the MLI replaces paragraph 7 of Article 5 of this Agreement:
ARTICLE
12 OF THE MLI - ARTIFICIAL AVOIDANCE OF PERMANENT ESTABLISHMENT
STATUS THROUGH COMMISSIONNAIRE ARRANGEMENTS AND SIMILAR
STRATEGIES
Paragraph 1 of Article 12 of
the MLI shall not apply where the person acting in a Contracting State on
behalf of an enterprise of the other Contracting State carries on business in
the first-mentioned
Contracting State as an
independent agent and acts for the enterprise in the ordinary course of that
business. Where, however, a person acts exclusively or almost exclusively on
behalf of one or more enterprises to which it is closely related, that person
shall not be considered to be an independent agent within the meaning of this
paragraph with respect to any such enterprise. |
8. The fact that a company which is a resident of a Contracting
State controls or is controlled by a company which is a resident of the other
Contracting State, or which carries on business in that other State (whether
through a permanent establishment or otherwise), shall not of itself constitute
either company a permanent establishment of the other.
|
The following paragraph 1 of
Article 15 of the MLI applies to provisions of this Agreement:
ARTICLE
15 OF THE MLI  DEFINITION OF A PERSON CLOSELY RELATED TO AN ENTERPRISE
For the purposes of Article 5
of the Agreement a person is closely related to an enterprise if, based on
all the relevant facts and circumstances, one has control of the other or
both are under the control of the same persons or enterprises. In any case, a
person shall be considered to be closely related to an enterprise if one
possesses directly or indirectly more than 50 per cent of the beneficial
interest in the other (or, in the case of a company, more than 50 per cent of
the aggregate vote and value of the companys shares or of the beneficial
equity interest in the company) or if another person possesses directly or
indirectly more than 50 per cent of the beneficial interest (or, in the case
of a company, more than 50 per cent of the aggregate vote and value of the
companys shares or of the beneficial equity interest in the company) in the
person and the enterprise. |
CHAPTER
Ill
TAXATION
OF INCOME
|
Article 6 |
1. Income derived by a resident of a Contracting State from
immovable property, including income from agriculture or forestry, situated in
the other Contracting State may be taxed in that other Contracting State.
2. The term "immovable property" shall have the meaning
which it has under the law of the Contracting State in which the property in
question is situated. The term shall in any case include property accessory to
immovable property, livestock and equipment used in agriculture and forestry,
rights to which the provisions of general law respecting landed property apply,
usufruct of immovable property and rights to variable or fixed payments as
consideration for the working of, or the right to work, mineral deposits,
sources and other natural resources. Ships, and aircraft shall not be regarded
as immovable property.
3. The provisions of paragraph 1 shall also apply to income
derived from the direct use, letting, or use in any other from of immovable
property.
4. The provisions of paragraphs 1 and 3 shall also apply to the
income from immovable property of an enterprise and to income from immovable
property used for the performance of independent personal services.

Article 7 |
1. The profits of an enterprise of a Contracting State shall be
taxable only in that State unless the enterprise carries on business in the
other Contracting State through a permanent establishment situated therein. If
the enterprise carries on business as aforesaid, the profits of the enterprise
may be taxed in the other State but only so much of them as is attributable to
that permanent establishment;
2. Subject to the provisions of paragraph 3, where an enterprise
of a Contracting State carries on business in the other Contracting State
through a permanent establishment situated therein, there shall in each
Contracting State be attributed to that permanent establishment the profits
which it might be expected to make if it were a distinct and separate enterprise
engaged in the same or similar activities under the same or similar conditions
and dealing wholly independently with the enterprise of which it is a permanent
establishment.
3. In determining the profits of a permanent establishment, there
shall be allowed as deductions expenses which are incurred for the purposes of
the business of the permanent establishment, including executive and general
administrative expenses so incurred, whether in the State in which the
permanent establishment is situated or elsewhere, In accordance with the
provisions of and subject to the limitations of the tax laws of that State.
However, no such deduction shall be allowed in respect of amounts, if any, paid
(otherwise than towards reimbursement of actual expenses) by the permanent
establishment to the head office of the enterprise or any of its other offices,
by way of royalties, fees or other similar payments in return for the use of
patents or other lights, or by way or commission, for specific services
performed or for management, or, except in the case of a banking enterprise, by
way of interest on moneys lent to the permanent establishment Likewise, no
account shall be taken, in the determination of the profits of a permanent
establishment, for amounts charged, (otherwise than towards reimbursement of
actual expenses), by the permanent establishment to the head office of the
enterprise or any of its other offices, by way of royalties, fees or other
similar payments in return for the use of patents or other rights, or by way of
commission for specific services performed or for management, or, except in the
case of banking enterprise, by way of interest on money lent to the head office
of the enterprise or any of its other offices.
4. Insofar as it has been customary in a Contracting State to
determine the profits to be attributed to a permanent establishment on the
basis of an apportionment of the total profits of the enterprise to its various
parts, nothing in paragraph 2 shall preclude that Contracting State from determining
the profits to be taxed by such an apportionment as may be customary; the
method of apportionment adopted shall, however, be such that the result shall
be in accordance with the principles contained in this Article.
5. No profits shall be attributed to a permanent establishment by
reason of the mere purchase by that permanent establishment of goods or
merchandise for the enterprise.
6. For the purposes of the preceding paragraphs, the profits to
be attributed to the permanent establishment shall be determined by the same
method year by year unless there is good and sufficient reason to the
contrary.
7. Where profits include items of income which are dealt with
separately in other Articles of this Agreement, then the provisions of those
Articles shall not be affected by the provisions of this Article.

Article 8 |
1. Profits derived by an enterprise of a Contracting State from
the operation of ships or aircraft in international traffic shall be taxable
only in the Contracting State in which the place of effective management of the
enterprise is situated .
2. If the place of effective management of a shipping enterprise
is aboard a ship, then it shall be deemed to be situated in the Contracting
State in which the home harbor of the ship is situated, or, if there is no such
home harbor, in the Contracting State of which the operator of the ship is a
resident.
3. The term "operation of ships or aircraft" means
business of transportation by sea or by air of passengers, mail, livestock or
goods carried on by the owners, fessees or charterers of ships or aircraft,
including the sale of tickets for such transportation on behalf of other
enterprises, the incidental lease of ships or aircraft and any other activity
directly connected with such transportation.
4. Notwithstanding the provisions of paragraphs 1 and 2, profits
from sources within a Contracting State derived by an enterprise of the other
Contracting State from the operation of ships in international traffic may be
taxed in the first-mentioned State, but the tax imposed in that Contracting
State shall be reduced by an amount equal to 50 per cent thereof.
5. Profits derived by a transportation enterprise which is a
resident of a Contracting State from the use, maintenance, or rental of
containers (including trailers and other equipment for the transport of
containers) used for the transport of goods or merchandise in international
traffic shall be taxable only in that Contracting State unless the containers
are used solely within the other contracting State.
6. For the purposes of this Article interest on investments directly
connected with the operation of ships or aircraft in international traffic
shall be regarded as profits derived from the operation of such ships or
aircraft if they are integral to the carrying on of such business, and the
provisions of Article 11 shall not apply in relation to such interest.
7. The provisions of paragraph 1 shall also apply to profits from
the participation in a pool, a joint business or an international operating
agency.

Article 9 |
1. Where :
(a) an enterprise of a Contracting State participates directly or
indirectly in the management, control or capital of an enterprise of the other
Contracting State, or
(b) the same persons participate directly or indirectly in the
management, control or capital of an enterprise of a Contracting State and an
enterprise of the other Contracting State,
and in either case conditions are
made or imposed between the two enterprises in their commercial or financial
relations which differ from those which would be made between independent
enterprises, then any profits which would, but for those conditions, have
accrued to one of the enterprises, but, by reason of those conditions, have not
so accrued, may be included in the profits of that enterprise and taxed
accordingly.
2. Where a Contracting State includes in the profits of an
enterprise of that State - and taxes accordingly - profits on which an
enterprise of the other Contracting State has been charged to tax in that other
State and the profits so included are profits which would have accrued to the
enterprise of the first - mentioned State if the conditions made between the
two enterprises had been those which would have been made between independent
enterprises, then that other State shall make an appropriate adjustment to the
amount of the tax charged therein on those profits. In determining such adjustment,
due regard shall be had to the other provisions of this Agreement and the
competent authorities of the Contracting States shall if necessary consult each
other.
3. The provision of paragraph 2 shall not apply where judicial,
administrative or other legal proceedings have resulted in a final ruling that
by actions giving rise to an adjustment of profits under paragraph 1, one of
the enterprises concerned is liable to penalty with respect to fraud, gross
negligence or wilful default.

Article 10 |
1. Dividends paid by a company which is a resident of a
Contracting State to a resident of the other Contracting State may be taxed in
that other State.
2. However, such dividends may also be taxed in the Contracting
State of which the company paying the dividends is a resident and according to
the laws of that State, but if the beneficial owner of the dividends is a
resident of the other Contracting State, the tax so charged shall not exceed 10
% (ten per cent) of the gross amount of the dividends.
This paragraph shall not affect
ihe taxation of the company in respect of the profits out of which the
dividends are paid.
3. The term "dividends" as used in this Article means
income from shares or other rights, not being debt-claims, participating in
profits, as well as income from other corporate rights which is subjected to
the same taxation treatment as income from shares by the laws of the State of
which the company making the distribution is a resident.
4. The provisions of paragraphs 1 and 2 shall not apply if the
beneficial owner of the dividends, being a resident of a Contracting State,
carries on business in the other Contracting State of which the company paying
the dividends is a resident, through a permanent establishment situated
therein, or performs in that other State independent personal services from a
fixed base situated therein, and the holding in respect of which the dividends
are paid is effectively connected with such permanent establishment or fixed
base. In such case, the provisions of Article 7 or Article 14, as the case may
be, shall apply.
5. Where a company which is a resident of a Contracting State
derives profits or income from the other Contracting State, that other State
may not impose any tax on the dividends paid by the company, except insofar as
such dividends are paid to a resident of that other State or insofar as the
holding in respect of which the dividends are paid is effectively connected
with a permanent establishment or a fixed base situated in that other State,
nor subject the companys undistributed profits to a tax on the companys
undistributed profits, even if the dividends paid or the undistributed profits
consist wholly or partly of profits or income arising in such other
State.

Article 11 |
1. Interest arising in a Contracting State and paid to a resident
of the other Contracting State may be taxed in that other State.
2. However, such interest may also be taxed in the Contracting
State in which it arises and according to the laws of that State, but if the
beneficial owner of the interest is a resident of the other Contracting State,
the tax so charged shall not exceed 10% (ten percent) of the gross amount of
the interest.
3. Notwithstanding the provisions of paragraph 2, interest
arising in a Contracting State shall be exempt from tax in that State, provided
that it is derived and beneficially owned by :
(a) the Government, a political sub-division or a local authority of
the other Contracting Stale; or
(b) (i) in the case of the
Republic of Indonesia:
(1) Bank Indonesia (the Central Bank of
Indonesia);
(2) Pusat Investasi Pemerintah (the Centre for
Government Investment), and
(3) Lembaga Pembiayaan Ekspor Indonesia (the
indonesia Eximbank);
(ii) in the case of India:
(1) Reserve Bank of India;
(2) Export-Import bank of India; and
(3) National Housing bank; or
(c) a statutory body or any institution wholly owned by the
Government of the Contracting States, as may he agreed from time to time
between the competent authorities of the Contracting States;
4. The term "interest†as used in this Article means income
from debt-claims of every kind, whether or not secured by mortgage and whether
or not carrying a right to participate in the debtor’s profits, and in
particular, income from government securities and income from bonds or
debentures, including premiums and prizes attaching to such securities, bonds
or debentures. Penalty charges for late payment shall not be regarded as
interest for the purpose of this Article.
5. The provisions of paragraphs 1 and 2 shall not apply if the
beneficial owner of the interest, being a resident of a Contracting State,
carries on business in the other Contracting State, in which the interest
arises, through a permanent establishment situated therein, or performs in that
other State independent personal services from a fixed base situated therein,
and the debt-claim in respect of which the interest is paid is effectively
connected with such permanent establishment or fixed base. In such case, the
provisions of Article 7 or Article 14, as the case may be, shall apply.
6. Interest shall be deemed to arise in a Contracting State when
the payer is a resident of that State Where, however, the person paying the
interest, whether he is a resident of a Contracting State or not, has in a
Contracting State a permanent establishment or a fixed base in connection with
which the indebtedness on which the interest is paid was incurred, and such
interest is home by such permanent establishment or fixed base, then such
interest shall be deemed to arise in the State in which the permanent
establishment or fixed base is situated.
7. Where, by reason of a special relationship between the payer
and the beneficial owner or between both of them and some other person, the
amount of the interest, having regard to the debt-claim for which it Is paid,
exceeds the amount which would have been agreed upon by the payer and the
beneficial owner in the absence of such relationship, the provisions of this
Article shall apply only to the last-mentioned amount of interest. In such
case, the excess part of the payments shall remain taxable according to the
laws of each Contracting State, due regard being had to the other provisions of
this Agreement.

Article 12 |
1. Royalties or fees for technical services arising in a
Contracting State and paid to a resident of the other Contracting State may be
taxed in that other State.
2. However, such royalties or fees for technical services may
also be taxed in the Contracting State in which they arise, and according to
the laws ot that State, but if the beneficial owner of the royalties or fees
for technical services is a resident of the other Contracting State, the tax so
charged shall not exceed 10% (ten per cent) of the gross amount of the
royalties or fees for technical services.
3. (a) The term
"royalties as used in this Article means payments of any kind received
as a consideration for the use of, or the right to use, any copyright of
literary, artistic or scientific work including cinematograph films, or films
or tapes used for radio or television broadcasting, any patent, trade mark,
design or model, plan, secret formula or process, or for the use of, or the
right to use, industrial, commercial or scientific equipment, or for
information concerning industrial, commercial or scientific experience.
(b) The term "fees for technical
services" as used in this Article means payments of any kind, other than
those mentioned in Articles 14 and 15 of this Agreement as consideration for
managerial or technical or consultancy services, including the provision of
services of technical or technical personnel.
4. The provisions of paragraphs 1 and 2 shall not apply if the
beneficial owner of the royalties
or fees for technical services, being a resident of a Contracting State,
carries on business in the other Contracting State in which the royalties or
fees for technical services arise, through a permanent establishment situated
therein, or performs in that other State independent personal services from a
fixed base situated therein, and the right or property in respect of which the
royalties or fees for technical services are paid is effectively connected with
such permanent establishment or fixed base. In such case, the provisions of
Article 7 or Article 14, as the case may be, shall apply.
5. (a) Royalties and
fees for technical services shall be deemed to arise in a Contracting State
when the payer is that State itself, a political sub-division, a local
authority, or a resident of that State. Where, however, the person paying the
royalties or fees for technical services, whether he is a resident of a
Contracting State or not, has in a Contracting State a permanent establishment
or a fixed base in connection with which the liability to pay the royalties or
fees for technical services was incurred, and such royalties or fees for
technical services are borne by such permanent establishment or fixed base,
then such royalties or fees for technical services shall be deemed to arise in
the Contracting State in which the permanent establishment or fixed base is
situated.
(b)
Where under sub-paragraph (a)
royalties or fees for technical services do not arise in one of the Contracting
States, and the royalties relate to the use of, or the right to use, the right
or property, or the fees for technical services relate to services performed,
in one of the Contracting States, the royalties or fees for technical services
shall be deemed to arise in that Contracting State.
6. Where, by reason of a special relationship between the payer
and the beneficial owner or between both of them and some other person, the
amount of the royalties or fees for technical services, having regard to the
use, right or information for which they are paid, exceeds the amount which
would have been agreed upon by the payer and the beneficial owner in the
absence of such relationship, the provisions of this Article shall apply only
to the last-mentioned amount of royalties. In such case, the excess part of the
payments shall remain taxable according to the laws of each Contracting State,
due regard being had to the other provisions of this Agreement.

Article 13 |
1. Gains derived by a resident of a Contracting State from the
alienation of immovable property referred to in Article 6 and situated in the
other Contracting State may be taxed in that other State.
2. Gains from the alienation of movable property forming part of
the business property of a permanent establishment which an enterprise of a
Contracting State has in the other Contracting State or of movable property
pertaining to a fixed base available to a resident of a Contracting State in
the other Contracting State for the purpose of performing independent personal
services, including such gains from the alienation of such a permanent
establishment (alone or with the whole enterprise) or of such fixed base, may
be taxed in that other State.
3. Gains derived by an enterprise of a Contracting State from the
alienation of ships or aircraft operated in international traffic or movable
property pertaining to the operation of such ships or aircraft shall be taxable
only in that Contracting State in which the place of effective management of
the enterprise is situated.
4. [REPLACED by paragraph
4 of Article 9 of the MLI] [Gains derived by a resident of a Contracting
State from the alienation of shares deriving more than 50 per cent of their
value directly or indirectly from immovable property situated in the other
Contracting State may be taxed in that other State.]

The following paragraph 4 of
Article 9 of the MLI replaces paragraph 4 of Article 13 of this Agreement:
ARTICLE
9 OF THE MLI  CAPITAL GAINS FROM ALIENATION OF SHARES OR INTERESTS
OF ENTITIES DERIVING THEIR VALUE PRINCIPALLY FROM IMMOVABLE
PROPERTY
For purposes of this Agreement,
gains derived by a resident of a Contracting State from the alienation of
shares or comparable interests, such as interests in a partnership or trust,
may be taxed in the other Contracting State if, at any time during the 365 days
preceding the alienation, these shares or comparable interests derived more
than 50 per cent of their value directly or indirectly from immovable
property (real property) situated in that other Contracting State. |
5. Gains from the alienation of shares other than those mentioned
in paragraph 4 in a company which is a resident of a Contracting State may be
taxed in that State.
6. Gains from the alienation of any property other than that
referred to in paragraphs 1, 2, 3, 4 and 5 shall be taxable only in the
Contracting State of which the alienator is a resident.
|
Article 14 |
1. Income derived by an individual who is a resident of a
Contracting State from the performance of professional services or other
independent activities of a similar character shall be taxable only in that
State except in the following circumstances when such income may also be taxed
in the other Contracting State:
(a)
if he has a fixed base regularly
available to him in the other Contracting State for the purpose of performing
his activities; in that case, only so much of the income as is attributable to
that fixed base may be taxed in that other State; or
(b) if his stay in the other Contracting State
is for a period oi periods amounting to or exceeding in the aggregate 91 days
in any period of twelve months; in that case, only so much of the income as is
derived from his activities performed in that other State may be taxed in that
other State.
2. The term "professional services" includes especially
independent scientific, literary, artistic, educational of teaching activities
as well as the independent activities of physicians, lawyers, engineers,
architects, surgeons, dentists and accountants.

Article 15 |
1. Subject to the provisions of Articles 16, 18, 19 and 20.
salaries, wages and other similar remuneration derived by a resident of a
Contracting State in respect of an employment shall be taxable only in that
State unless the employment is exercised in the other Contracting State. If the
employment is so exercised, such remuneration as is derived therefrom may be
taxed in that other State.
2. Notwithstanding the provisions of paragraph 1, remuneration
derived by a resident of a Contracting State in respect of an employment
exercised in the other Contracting State shall be taxable only in the
first-mentioned State if:
(a) the recipient is present in the other State for a period or
periods not exceeding in the aggregate 183 days in any twelve month period commencing
or ending in the fiscal year concerned, and
(b) the remuneration is paid by, or on behalf of, an employer who is
not a resident of the other State; and
(c) the remuneration is not borne by a permanent establishment or a
fixed base which the employer has in the other State.
3. Notwithstanding the preceding provisions of this Article,
remuneration derived in respect of an employment exercised aboard a ship or
aircraft operated in international traffic, may be faxed in the Contracting
State in which the place of effective management of the enterprise is
situated.

Article 16 |
Directors’ fees and other similar
payments derived by a resident of a Contracting State in his capacity as a
member of the board of directors or similar organ of a company which is a
resident of the other Contracting State may be taxed in that other State.
|
Article 17 |
1. Notwithstanding the provisions of Articles 14 and 15, income
derived by a resident of a Contracting State as an entertainer, such as a
theatre, motion picture, radio or television artiste, or a musician, or as a
sportsperson, from his personal activities as such exercised in the other
Contracting State, may be taxed in that other State.
2 Where
income in respect of personal activities exercised by an entertainer or a
sportsperson in his capacity as such accrues not to the entertainer or
sportsperson himself but to another person, that income may, notwithstanding
the provisions of Articles 7, 14 and 15, be taxed in the Contracting State in
which the activities of the entertainer or sportsperson are exercised
3 The
provisions of paragraphs 1 and 2 shall not apply to income from activities
performed in a Contracting State by entertainers or sportspersons if the
activities are substantially supported by public funds of one or both of the
Contracting States, a local authority or public institution thereof, in such a
case, the income shall be taxable only in the Contracting State of which the
entertainer or sportsperson is a resident.
|
Article 18 |
1. Subject to the provisions of paragraph 2 of Article 19,
pensions and other similar remuneration paid in consideration of past
employment and annuity paid to a resident of a Contracting State shall be
taxable only in that State.
2. The term “annuity" means a stated sum payable periodically
at stated times during life or during a specified or ascertainable period of
time under an obligation to make the payments in return for adequate and full
consideration in money or moneys worth.

Article 19 |
1. (a) Salaries, wages
and other similar remuneration, other than a pension, paid by a Contracting
State, or a political subdivision, or a local authority thereof to an
individual in respect of services rendered to that State or subdivision or
authority or body shall be taxable only in that State;
(b) However, such salaries, wages and other similar remuneration shall be taxable only in the other Contracting State
if the services are rendered in that State and the individual is a resident of
that State who;
(i) is a national of that State, or
(ii) did not become a resident of that State solely for the purpose of rendering the services.
2. (a) Any pension
paid by, or out of funds created by, a Contracting State or a political
subdivision or a local authority thereof to an individual in respect of
services rendered to that State or subdivision or authority shall be taxable
only in that State.
(b) However, such pension shall be taxable only
in the other Contracting State if the individual is a resident of, and a
national of, that other State;
3. The provisions of Article 15, 16, 17, and 18 shall apply to
salaries„ wages and other similar remuneration, and to pensions in respect of
services rendered in connection with a business carried on by a Contracting
State or a political subdivision or a local authority body thereof.
|
Article 20 |
1. A professor, teacher or research scholars who is or was a
resident of one of the Contracting States immediately before visiting the other
Contracting State for the purpose of teaching or engaging in research, or both,
at a university, college, school, museum or other approved institution in that
other Contracting State shall be exempt from tax in that other State on any
remuneration for such teaching or research for a period not exceeding two years
from the date of his first arrival in that other State.
2. This Article shall not apply to income from research if such
research is undertaken primarily for the private benefit of a specific person
or persons.
3. For the purposes of this Article, an individual shall be deemed
to be a resident of a Contracting State if he is resident in that Contracting
State in the fiscal year of income in which he visits the other Contracting
State or in the immediately preceding fiscal year of income.
4 For
the purposes of paragraph 1, "approved institution" means an
institution which has been approved in this regard by the competent authority
of the concerned Contracting State.
|
Article 21 |
1. Payments which a student or apprentice who is or was
immediately before visiting a Contracting State a resident of the other
Contracting State and who is present in the frist- mentioned State solely for
the purpose of his education or training receives for the purpose of his
maintenance, education or training shall not be taxed in that State, provided
that such payments arise from sources outside that State.
2. The benefits of this Article shall extend only for such period
of time as may be reasonable or customarily required to complete the education
or training undertaken, but in no event shall any individual have the benefits
of this Article:
(i)
in the case of student: for more than
five consecutive years from the date of his first arrival for the purposes of
his education in the Contracting State.
(ii)
in the case of apprentice: for more
than two consecutive years from the date of his first arrival for the purposes
of his training in the Contracting State.
|
Article 22 |
1. Items of income of a resident of a Contracting State, wherever
arising, not dealt with in the foregoing Articles of this Agreement shall be
taxable only in that State.
2. The provisions of paragraph 1 shall nol apply to income, other
than income from immovable property as defined in paragraph 2 of Article 6, if
the recipient of such income, being a resident of a Contracting State, carries
on business in the other Contracting State through a permanent establishment
situated therein, or performs in that other State independent personal services
from a fixed base situated therein, and the right or property in respect of
which the income is paid is effectively connected with such permanent
establishment or fixed base. In such case, the provisions of Article 7 or
Article 14, as the case may be, shall apply.
3. Notwithstanding the provisions of paragraphs 1 and 2, Items of
income of a resident of a Contracting State not dealt with in the foregoing
Articles of this Agreement and arising in the other Contracting State may also
be taxed in that other State.
CHAPTER
IV
METHODS
FOR ELIMINATION OF DOUBLE TAXATION
|
Article 23 |
1. Where a resident of a Contracting State derives income which,
in accordance with the provisions of this Agreement, may be taxed in the other
Contracting State, the first-mentioned State shall allow as deduction from the
tax on the income of that resident an amount equal to the income tax paid in
that other State, Such deduction shall not, however, exceed the part of the
income tax as computed before the deduction is given, which is attributable as
the case may be, to the income which may be taxed in that other State.
2. Where in accordance with any provision of the Agreement,
income derived by a resident of a Contracting State is exempt from tax in that
State, that State may nevertheless, in calculating the amount of tax on the
remaining income of such resident, take into account the exempted
income.
CHAPTER
V
SPECIAL
PROVISIONS
|
Article 24 |
1. The provisions of this Agreement shall in no case prevent a
Contracting Stale from the application of the provisions of its domestic law
and measures concerning tax avoidance or evasion, whether or not described as
such.
2. [REPLACED by paragraph
1 of Article 7 of the MLI] [A resident of a Contracting State shall not be
entitled to the benefits of this Agreement if its affairs were arranged in such
a manner as if it was tire main purpose or one of the main purposes to take the
benefits ot this Agreement.]
3. [REPLACED by paragraph
1 of Article 7 of the MLI] [The case of legal entities not having bonafide
business activities shall be covered by the provisions of this Article.]

The following paragraph 1 of
Article 7 of the MLI replaces paragraph 2 and paragraph 3 of Article 24 of
this Agreement:
ARTICLE
7 OF THE MLI  PREVENTION OF TREATY ABUSE (Principal
purposes test provision)
Notwithstanding any provisions
of a this Agreement, a benefit under this Agreement shall not be granted in
respect of an item of income or capital if it is reasonable to conclude,
having regard to all relevant facts and circumstances, that obtaining that
benefit was one of the principal purposes of any arrangement or transaction
that resulted directly or indirectly in that benefit, unless it is
established that granting that benefit in these circumstances would be in
accordance with the object and purpose of the relevant provisions of this
Agreement. |
|
Article 25 |
1. Nationals of a Contracting State shall not be subjected in the
other Contracting State to any taxation ot any requirement connected therewith,
which is other or more burdensome than the taxation and connected requirements
to which nationals of that other State in the same circumstances, in particular
with respect to residence, are or may be subjected. This provision shall,
notwithstanding the provisions of Article 1, also apply to persons who are not
residents of one or both of the Contracting States.
2. The taxation on a permanent, establishment which an enterprise
of a Contracting State has in the other Contracting State shall not be less
favorably levied in that other State than the taxation levied on enterprise of
that other State carrying on the same activities. This provision shall not bo
construed as obliging a Contracting State to grant to resident of the other
Contracting State any personal allowances, reliefs and reductions for taxation
purposes on account of civil Status or family responsibilities which it grants
to its own residents.
3 Enterprises
of a Contracting State, the capital of which is wholly or partly owned or
controlled, directly or indirectly, by one or more residents of the other
Contracting State, shall not be subjected in the first-mentioned State to any
taxation or any requirement connected therewith which is other or more
burdensome than the taxation and connected requirements to other similar
enterprises of the first mentioned State are or may be subjected.
4 Except
where the provisions of paragraph 1 of Article 9, paragraph 7 of Article 11, or
paragraph 6 of Article 12 apply, interest, royalties and other disbursement
paid by an enterprise of a Contracting State to a resident of the other
Contracting State shall, for the purpose of determining the taxable profits of
such enterprise, be deductible under the same conditions as it they had been
paid to a resident of the first-mentioned State.
5. In this Article the term "taxation" means taxes
which are the subject of this Agreement.
|
Article 26 |
1. Where a person considers that the actions of one or both of
the Contracting States result or will result for him in taxation not in
accordance with the provisions of this Agreement, he may, irrespective of the
remedies provided by the domestic law of those States, present his case to the
competent authority of the Contracting State of which he is a resident or, if
his case comes under paragraph 1 of Article 25, to that of the Contracting
State of which he is a national. The case must be presented within three years
from the first notification of the action resulting in taxation not in
accordance with the provisions of the Agreement.
2 The
competent authority shall endeavour, if the objection appears to it to be
justified and if it is not itself able to arrive at a satisfactory solution, to
resolve the case by mutual agreement with the competent authority of the other
Contracting State, with a view to the avoidance of taxation which is not in
accordance with the Agreement Any agreement reached shall be implemented
notwithstanding any time-limits in the domestic law of the Contracting States.
3 The
competent authorities of the Contracting States shall endeavour to resolve by
mutual agreement any difficulties or doubts arising as to the interpretation or
application of the Agreement They may also consult together for the elimination
of double taxation in cases not provided for in the Agreement.
4 The
competent authorities of the Contracting States may communicate with each other
directly for the purpose of reaching an agreement in the sense of the preceding
paragraphs. The competent authorities, through consultations, shall develop
appropriate bilateral procedures, conditions, methods and techniques for the
implementation of the mutual agreement procedure provided for in this
Article.
|
Article 27 |
1. The competent authorities of the Contracting States shall
exchange such information (including documents or certified copies of the
documents) as is foreseeably relevant for carrying out the provisions of this
Agreement or to the administration or enforcement of the domestic laws
concerning taxes of every kind and description imposed on behalf of the
Contracting States, or of their political subdivisions or local authorities,
insofar as the taxation thereunder is not contrary to the Agreement. The exchange
of information is not restricted by Articles 1 and 2.
2 Any
information received under paragraph 1 by a Contracting State shall be treated
as secret in the same manner as information obtained under the domestic laws of
that State and shall be disclosed only to persons or authorities (including
courts and administrative bodies) concerned with the assessment or collection
of, the enforcement or prosecution in respect of, or the determination of
appeals in relation to the taxes referred to in paragraph 1, or the oversight
of the above. Such persons or authorities shall use the information only for
such purposes. They may disclose the information in public court proceedings or
in judicial decisions.
3. In no case shall the provisions of paragraphs 1 and 2 be
construed so as to impose on a Contracting State the obligation:
(a) to carry out administrative measures at
variance with the laws and the administrative practice of that or of the other
Contracting State.
(b) to supply information (including documents
or certified copies of the documents) which is not obtainable under the laws or
in the normal course of the administration of that or of the other Contracting
State;
(c)
to supply information which would
disclose any trade, business, industrial commercial or professional secret or
trade process, or information, the disclosure of which would be contrary to
public policy (ordre public).
4. If the information is requested by a Contracting State in
accordance with this Article, the other Contracting State shall use its
information gathering measures to obtain, the requested information, even
though that other State may not need such information for its own tax purposes
The obligation contained in the preceding sentence is subject to the
limitations of paragraph 3, but in no case shall such limitations be construed
to permit a Contracting State to decline to supply information solely because
it has no domestic interest in such information.
5 In
no case shall the provisions of paragraph 3 be construed to permit a
Contracting State to decline to supply information solely because the
information is held by a bank, other financial institution, nominee or person
acting in an agency or a fiduciary capacity or because it relates to ownership
interests in a person.

Article 28 |
1. The Contracting States shall lend assistance to each other in
the collection of revenue claims. This assistance is not restricted by Articles
1 and 2. The competent authorities of the Contracting States may by mutual
agreement settle the mode of application of this Article.
2. The term "revenue claim" as used in this Article
means an amount owed in respect of taxes of every kind and description imposed
on behalf of the Contracting States, or of their political subdivisions or
local authorities, insofar as the taxation thereunder is not contrary to this
Convention or any other instrument to which the Contracting States are parties,
as well as interest, administrative penalties and costs of collection or
conservancy related to such amount.
3. When a revenue claim of a Contracting State is enforceable
under the laws of that State and is owed by a person who, at that time, cannot,
under the laws of that State, prevent its collection, that revenue claim shall
at the request of the competent authority of that State, be accepted for purposes
of collection by the competent authority of the other Contracting State. That
revenue claim shall be collected by that other State in accordance with the
provisions of its laws applicable to the enforcement and collection of its own
taxes as if the revenue claim were a revenue claim of that other State.
4. When a revenue claim of a Contracting State is a claim in
respect of which that State may, under its law, take measures of conservancy
with a view to ensure its collection, that revenue claim shall, at the request
of the competent authority of that State, be accepted for purposes of taking
measures of conservancy by the competent authority of the other Contracting
State. That other State shall take measures of conservancy in respect of that
revenue claim in accordance with the provisions of its laws as if the revenue
claim were a revenue claim of that other State even if, at the time when such
measures are applied, the revenue claim is not enforceable in the
first-mentioned State or is owed by a person who has a right to prevent its
collection.
5. Notwithstanding the provisions of paragraphs 3 and 4, a
revenue claim accepted by a Contracting State for purposes of paragraph 3 or 4
shall not, in that State, be subject to the time limits or accorded any
priority applicable to a revenue claim under the laws of that State by reason
of its nature as such. In addition, a revenue claim accepted by a Contracting
State for the purposes of paragraph 3 or 4 shall not, in that State, have any
priority applicable to that revenue claim under the laws of the other
Contracting State.
6. Proceedings with respect to the existence, validity or the
amount of a revenue claim of a Contracting State shall only be brought before
the courts or administrative bodies of that State. Nothing in this Article
shall be construed as creating or providing any right to such proceedings
before any court or administrative body of the other Contracting State.
7. Where, at any time after a request has been made by a
Contracting State under paragraph 3 or 4 and before the other Contracting State
has collected and remitted the relevant revenue claim to the first-mentioned
State, the relevant revenue claim ceases to be:
(a) in the case of a request under paragraph 3,
a revenue claim of the first- mentioned State that is Enforceable under the
laws of that State and is owed by a person who, at that time, cannot, under the
laws of that State prevent its collection, or
(b) in the case of a request under paragraph 4,
a revenue claim of the first-mentioned State in respect of which that State
may, under its laws, take measures of conservancy with a view to ensure its
collection.
the
competent authority of the first-mentioned State shall promptly notify the
competent authority of the other State of thal fact and, at the option of the
other State, the first-mentioned State shall either suspend or withdraw its
request.
8. In no case shall the provisions of this Article be construed
so as to impose on a Contracting State the obligation:
(a)
to carry out administrative measures
at variance with the laws and administrative practice of that of of the other
Contracting State;
(b)
to carry out measures which would be
contrary to public policy (order public);
(c) to provide assistance if the other
Contracting State has not pursued all reasonable measures of collection or
conservancy, as the case may be, available under its laws or administrative
practice,
(d) to provide assistance in those cases where
the administrative burden for that State is clearly disproportionate to the
benefit to be derived by the other Contracting State.

Article 29 |
Nothing in this Agreement shall
affect the fiscal privileges of members of diplomatic missions or consular
posts under the general rules of international law or under the provisions of
special agreements.
|
The following paragraph 1 of
Article 7 of the MLI applies and supersedes the provisions of this Agreement:
ARTICLE
7 OF THE MLI  PREVENTION OF TREATY ABUSE (Principal
purposes test provision)
Notwithstanding any provisions
of a the Agreement, a benefit under the Agreement shall not be granted in
respect of an item of income if it is reasonable to conclude, having regard
to all relevant facts and circumstances, that obtaining that benefit was one
of the principal purposes of any arrangement or transaction that resulted
directly or indirectly in that benefit, unless it is established that
granting that benefit in these circumstances would be in accordance with the
object and purpose of the relevant provisions of the Agreement. |
CHAPTER
VI
FINAL
PROVISIONS
|
Article 30 |
1. Each of the Contracting States shall notify the other
Contracting State through diplomatic channels the completion of the procedures
required by its law for the bringing into force of this Agreement.
2. This Agreement shall enter into force on the date of the later
of the notifications referred to in paragraph 1 of this Article.
3. The provisions of this Agreement shall have effect as follows:
(a) In Indonesia;
(i) in respect of taxes withheld at source:
for amounts paid or credited on or after the first day of January next
following the date on which this Agreement enters into force, and
(ii) in respect of other taxes: for any tax
year commencing on or after the first day of January next following the date on
which this Agreement enters into force.
(b) In India, in respect of income derived in
any fiscal year beginning on or after the first day of April next following the
calendar year in which the Agreement enters into force.
4. The Agreement between the Government of the Republic of
Indonesia and the Government of the Republic of India for the Avoidance of
Double Taxation and Prevention of fiscal evasion with respect to taxes on
income signed at Jakarta on the 7th August, 1987 shall cease to have effect
when the provisions of this Agreement become effective in accordance with the
provisions of paragraph 3 of this Article.

Article 31 |
This Agreement shall remain in
force indefinitely until terminated by one of the Contracting States. Either
Contracting State may terminate the Agreement, through diplomatic channels, by
giving notice of termination at least six months before the end of any calendar
year beginning after the expiration of five years from the date of entry into
force of the Agreement. In such event, the Agreement shall cease to have
effect:
(a) In Indonesia ;
(i) in respect of taxes withheld at source: for
amount paid or credited on or after the first day of January in the calendar
year immediately following that in which the notice of such termination is
given, and
(ii) in respect of other taxes: for any tax
year commencing on or after the first day of January in the calendar year
immediately following that in which the notice of such termination is given.
(b) In India, in respect of income derived in any fiscal year on or
after the first day of April next following the calendar year in which the
notice is given .
IN WITNESS WHEREOF, the
undersigned, duly authorized thereto, have signed this Agreement.

R O T O C O L
At the moment of signing the
Agreement this day concluded between the Government of the Republic of
Indonesia and the Government of the Republic of India for the Avoidance of
Double Taxation and the Prevention of Fiscal Evasion with respect to Taxes on Income,
the undersigned have agreed upon the following provisions which shall be an
integral part of the Agreement :
1. With reference to paragraph 1 of Article 7 (Business Profits),
it is understood that profits derived from the sale of goods or merchandise of
the same or similar kind as those sold, or from other business activities of
the same or similar kind as those effected, through that permanent
establishment, may be considered attributable to that permanent establishment
if it is proved that :
(i) this transaction has been resorted to in
order to avoid taxation in the Contracting State where the permanent
establishment is situated, and
(ii) the permanent establishment in any way was
involved in this transaction.
2. It is understood that the provisions of paragraphs 1 and 2 of
Articles 11 (Interest) and 12 (Royalties and Fees for Technical Services) shall
not apply and provisions of Article 7 (Business Profits) shall apply if the
income is effectively connected wilh business activities referred to in paragraph
1 of this Protocol.
3. Notwithstanding anything contained in this Agreement, it is
understood that nothing shall prevent a Contracting State from charging the
profits of a permanent establishment of an enterprise of the other Contracting
State at a rate of tax which is higher than that imposed on the profits of a
Similar company of the first mentioned State and it shall neither be construed
as discriminatory with respect to Article 25 (Non-discrimination) nor as being
in conflict with the provisions of paragraph 3 of Article 7 (Business Profits)
4. For purposes of Article 7 where a company which is a resident
of a Contracting State has a permanent establishment in the other Contracting
State, the profits attributable to the permanent establishment may be subjected
to an additional tax or branch profits tax in that other State in accordance
with its law, but such tax so charged shall not exceed a rate of 15% (fifteen
per cent).
5. It is understood that in the event of conflict in application
between the provisions of this Agreement and the provisions of production
sharing contracts relating to the exploitation and production of oil and
natural gas in a Contracting State entered into by the Government or any person
authorized by it the latter shall prevail.
6 In respect of paragraph 2 of Article 27 (Exchange of
Information), it is understood that, information received by a Contracting
State may be used for other Government enforcement purposes when such
information may be used for such other Government enforcement purposes under
the laws of both States and the competent authority of the supplying State
authorises such use.
IN WITNESS WHEREOF, the

PAJAK BERGANDA DAN PENCEGAHAN PENGELAKAN
PAJAK YANG BERHUBUNGAN
DENGAN PAJAK-PAJAK ATAS PENGHASILAN
Pemerintah Republik
Indonesia dan Pemerintah Republik India, berhasrat untuk mengadakan suatu
Persetujuan mengenai penghindaran pajak berganda dan pencegahan pengelakan
pajak yang berhubungan dengan pajak-pajak atas penghasilan dan dengan maksud
untuk meningkatkan kerjasama ekonomi antara kedua Negara
telah menyetujui
sebagai berikut
BAB I
RUANG LINGKUP
PERSETUJUAN
|
Pasal 1 |
Persetujuan ini berlaku
terhadap orang atau badan yang menjadi penduduk salah satu atau kedua Negara
Pihak.
|
Pasal 2 |
1. Persetujuan ini berlaku terhadap
pajak-pajak atas penghasifan yang dikenakan untuk kepentingan masing-masing
Negara Pihak, atau bagian-bagian ketatanegaraannya atau pemerintah-pemerintah
daerahnya, tanpa memperhatikan cara pemungutan pajak-pajak tersebut.
2. Pajak-pajak atas penghasilan yang
dimaksud adalah semua pajak yang dikenakan atas seluruh penghasilan, atau
unsur-unsur penghasilan, termasuk pajak atas keuntungan yang diperoleh dari
pemindahtanganan harta gerak atau tak bergerak dan pajak-pajak atas keseluruhan
upah atau gaji yang dibayarkan oleh perusahaan.
3 Pajak-pajak yang berlaku dalam
Persetujuan ini khususnya adalah
(a) dalam hal
Indonesia : pajak penghasilan; (selanjutnya disebut "pajak
Indonesia");
(b) dalam hal India
: pajak penghasilan, termasuk setiap tambahan yang dikenakan, (selanjutnya
disebut "pajak India")
4. Persetujuan ini berlaku pula terhadap
pajak-pajak yang serupa atau yang pada dasarnya sama yang dikenakan setelah
tanggal penandatanganan Persetujuan ini sebagai tambahan terhadap, atau sebagai
pengganti dari, pajak-pajak yang saat ini bedaku. Para pejabat yang berwenang
dari kedua Negara Pihak akan saling memberitahukan satu sama lain setiap
perubahan substansial yang terjadi dalam perundang-undangan perpajakan negara
mereka.
BAB II
PENGERTIAN-PENGERTIAN
|
Pasal 3 |
1. Untuk kepentingan dari Persetujuan ini,
kecuali jika dari hubungan kalimatnya harus diartikan lain:
(a) istilah
"Republik Indonesia" meliputi wilayah Republik Indonesia sebagaimana
ditetapkan dalam perundang-undangannya dan bagian-bagian dari landas kontinen,
zona ekonomi eksklusif dan perairan di sekitarnya di mana Republik Indonesia
memiliki kedaulatan, hak-hak kedaulatan atau yurisdiksi sesuai dengar Konvensi
Hukum Laut Perserikatan Bangsa-Bangsa Tahun 1982;
(b) istilah
"India" berarti wilayah India dan termasuk laut wilayah dan ruang
udara diatasnya, dan zona maritim lainnya di mana India memiliki kedaulatan,
hak-hak lainnya dan yurisdiksi, menurut perundang-undangan India dan sesuai
dengan hukum internasional, termasuk Konvensi Hukum Laut Perserikatan Bangsa
Bangsa Tahun 1982;
(c) istilah
"Negara Pihak" dan "Negara Pihak lainnya" berarti Republik
Indonesia atau Republik India, sesuai dengan hubungan kalimatnya;
(d) istilah
"orang atau badan" meliputi orang pribadi, perseroan, kumpulan
orang-orang atau badan-badan dan setiap kesatuan lainnya yang diperlakukan
sebagai suatu entitas yang dapat dikenakan pajak berdasarkan perundang-undangan
pajak yang berlaku di masing-masing Negara Pihak;
(e) istilah
"perseroan" berarti setiap badan hukum atau setiap entitas yang untuk
tujuan perpajakan diperlakukan sebagai badan hukum;
(f) istilah
"perusahaan†berlaku untuk segala/seluruh kegiatan usaha;
(g) istilah
"perusahaan dari suatu Negara Pihak" dan "perusahaan Negara
Pihak lainnya" masing-masing berarti suatu perusahaan yang dijalankan oleh
penduduk dari suatu Negara Pihak dan suatu perusahaan yang dijalankan oleh
penduduk dari Negara Pihak lainnya:
(h) istilah
"lalu lintas internasional" berarti setiap pengangkutan oleh kapal
laut atau pesawat udara yang dioperasikan oleh suatu perusahaan dari suatu
Negara Pihak, kecuali apabila kapal laut atau pesawat udara tersebut
semata-mata dioperasikan antara tempat-tempat dl Negara Pihak lainnya;
(i) istilah
"warga negara" berarti
(1) setiap
orang pribadi yang memiliki kewarganegaraan dari suatu Negara Pihak; dan
(2) setiap
badan hukum, kemitraan atau persekutuan yang memperoleh statusnya berdasarkan
perundang-undangan yang berlaku di suatu Negara Pihak.
(j) istilah
"pejabat yang berwenang" berarti:
(1) dalam
hal Republik Indonesia, Menteri Keuangan atau Wakilnya yang sah:
(2) dalam
hai Republik India, Menteri Keuangan atau Wakilnya yang sah:
(k) istiiah
"pajak" berarti pajak Indonesia atau pajak India tergantung dari
hubungan kalimatnya, tetapi tidak akan termasuk setiap jumlah yang terutang
karena pelanggaran atau kelalaian dalam hubungannya dengan pajak-pajak terhadap
mana Persetujuan ini berlaku atau berupa pengenaan hukuman atau denda yang
menyangkut pajak-pajak tersebut;
2. Sehubungan dengan penerapan Persetujuan
setiap saat oleh salah satu Negara Pihak, setiap istilah yang tidak dijelaskan
dalam Persetujuan ini, kecuali jika dari hubungan kalimatnya diartikan lain,
mempunyai arti sesuai dengan perundang-undangan Negara itu untuk kepentingan perpajakan
yang diatur dalam Persetujuan ini, setiap pengertian menurut perundang-undangan
perpajakan yang berlaku di Negara Itu melampaui pengertian yang diberikan
menurut perundang-undangan lainnya di Negara tersebut untuk istilah tersebut

Pasal 4 |
1 Untuk kepentingan Persetujuan ini,
istiiah "penduduk suatu Negara Pihak†berarti setiap orang yang menurut
perundang-undangan Negara tersebut dapat dikenakan pajak di Negara itu
berdasarkan domisilinya, tempat kediamannya, tempat kedudukan manajemennya
ataupun dasar lainnya yang sifatnya serupa, dan juga termasuk Negara tersebut
beserta bagian ketatanegaraan dan pemerintah daerahnya. Tetapi istilah Ini
tidak termasuk orang atau badan yang dapat dikenakan pajak di Negara itu hanya
dari penghasilan yang bersumber di Negara tersebut.
2 Apabila karena adanya
ketentuan-ketentuan pada ayat 1 seseorang menjadi penduduk di kedua Negara
Pihak, maka statusnya akan ditentukan sebagai berikut :
(a) la hanya akan
dianggap sebagai penduduk dari Negara Pihak di mana ia mempunyai tempat tinggal
tetap yang tersedia baginya; jika ia mempunyai tempat tinggal tetap yang
tersedia di kedua Negara Pihak, ia akan dianggap sebagai penduduk dari Negara
Pihak di mana terdapat hubungan-hubungan pribadi dan ekonomi yang lebihi erat
(pusat kepentingan-kepentingan pokok);
(b) jika Negara
Pihak di mana pusat kepentingan-kepentingan pokoknya tidak dapat ditentukan,
atau jika ia tidak mempunyai tempat tinggal tetap yang tersedia baginya di
Negara Pihak manapun, maka ia hanya akan dianggap sebagai penduduk dari Negara
Pihak di mana ia biasanya menetap;
(c) jika ia
mempunyai kebiasaan menetap di kedua Negara Pihak atau tidak di kedua-duanya,
maka la akan dianggap penduduk dari Negara Pihak di mana ia merniiiki
kewarganegaraan;
(d) jika status
kependudukannya tidak dapat ditentukan karena alasan huruf (a) sampai dengan
huruf (c) di atas, pejabat-pejabat yang berwenang dari Negara Pihak akan
menyelesaikan masalah tersebut melalui persetujuan bersama.
3 Apabila berdasarkan ketentuan-ketentuan
pada ayat 1, orang atau badan selain orang pribadi merupakan penduduk di kedua
Negara Pihak, maka badan tersebut akan dianggap sebagai penduduk dari Negara
Pihak di mana tempat manajemen efektifnya berada Jika Negara di mana tempat
manajemen efektif berada tidak dapat ditentukan, maka pejabat yang berwenang
dari Negara Pihak akan menyelesaikan permasalahan melalui persetujuan bersama.

Pasal 5 |
1 Untuk Kepentingan Persetujuan ini,
istilah "bentuk usaha tetap" berarti suatu tempat usaha tetap di mana
seluruh atau sebagian usaha suatu perusahaan dari suatu Negara Pihak dijalankan
2 Istilah "bentuk usaha tetap"
terutama Khususnya meliputi:
(a) suatu tempat
kedudukan manajemen.
(b) suatu cabang,
(c) suatu kantor;
(d) suatu pabrik;
(e) suatu bengkel:
(f) suatu
gudang yang berhubungan dengan orang yang menyediakan fasilitas penyimpanan
untuk orang lain;
(g) bangunan
sebagai tempat penjualan;
(h) lahan pertanian
atau tempat lain di mana pertanian, kehutanan, perkebunan atau kegiatan yang
terkait dilakukan; dan
(i) suatu tambang,
suatu sumur minyak atau gas, suatu tempat penggalian atau tempat ekstraksi
sumber daya alam
3 Istilah "bentuk usaha tetap"
juga meliputi :
(a) suatu bangunan
atau suatu kontruksi atau suatu proyek perakitan atau proyek instalasi atau
kegiatan pengawasan yang berhubungan dengan proyek tersebut, tetapi hanya jika
bangunan, proyek atau kegiatan tersebut berlangsung untuk masa lebih dari 183
hari;
(b) alat pengeboran
atau kapal pengeboran yang digunakan untuk eksplorasi atau eksploitasi sumber
daya alam, tetapi hanya jika digunakan untuk masa lebih dari 183 hari;
(c) pemberian jasa
termasuk jasa konsultasi yang dilakukan oleh suatu perusahaan melalui
karyawannya atau orang lain yang dipekerjakan oleh perusahaan itu unluk tujuan
tersebut, tetapi hanya jika kegiatan-kegiatan tersebut berlangsung (untuk
proyek yang sama atau ada kaitannya) di suatu Negara Pihak dalam masa atau
masa-masa yang berjumlah lebih dari 91 hari dalam jangka waktu dua belas bulan,

sebelumnya dan Pasal ini, istilah "bentuk usaha tetap" dianggap tidak
meliputi:
(a) penggunaan
fasilitas-fasiiilas semata-mata dengan maksud untuk menyimpan atau memamerkan
barang-barang atau barang dagangan milik perusahaan;
(b) pengurusan
suatu persediaan barang-barang atau barang dagangan milik perusahaan
semata-mata dengan maksud untuk disimpan atau dipamerkan;
(c) pengurusan
suatu persediaan barang-barang atau barang dagangan milik perusahaan
semata-mata dengan maksud untuk diolah oleh perusahaan lain;
(d) pengurusan
suatu tempat usaha tetap semata-mata dengan maksud untuk pembelian
barang-barang atau barang dagangan, atau untuk mengumpulkan informasi, bagi
keperluan perusahaan,
(e) pengurusan
suatu tempat usaha tetap semata-mata dengan maksud menjalankan setiap kegiatan
lain yang bersifat persiapan atau penunjang bagi perusahaan;
(f) pengurusan
suatu tempat usaha tetap semata-mata dengan maksud untuk melakukan gabungan
kegiatan-kegiatan seperti disebutkan pada sub-ayat (a) sampai dengan sub-ayat (e), sepanjang secara keseluruhan
kegiatan- kegiatan tempat usaha tetap yang dihasilkan dari penggabungan
tersebut bersifat persiapan atau penunjang,
5. Menyimpang dari ketentuan-ketentuan pada
ayat 1 dan 2, apabila orang, kecuali agen yang bertindak bebas sebagaimana
berlaku ayat 7, bertindak di suatu Negara Pihak atas nama perusahaan yang
berkedudukan di Negara Pihak lainnya, maka perusahaan tersebut dianggap
memiliki bentuk usaha tetap di Negara yang disebutkan pertama atas
kegiatan-kegiatan yartg dilakukan oleh orang tersebut, jika orang tersebut:
(a) mempunyai dan
biasa menjalankan wewenang di Negara itu untuk menandatangani kontrak-kontrak
atas nama perusahaan tersebut, kecuali kegiatan itu hanya terbatas pada apa
yang dimaksud dalam ayat 4, yang jika dilakukan melalui suatu tempat usaha yang
tetap, tidak akan menjadikan tempat tersebut bentuk usaha tetap sesuai dengan
ketentuan ayat tersebut; atau
(b) tidak mempunyai
wewenang, tetapi biasa mengurus suatu persediaan barang-barang atau
barang-barang dagangan di Negara yang disebutkan pertama di mana ia secara
teratur mengirimkan barang-barang atau barang- barang dagangan atas nama
perusahaan;
(c) biasa
melaksanakan pesanan di Negara yang disebutkan pertama, seluruhnya atau hampir
seluruhnya untuk perusahaan itu sendiri.
6. Menyimpang dari ketentuan-ketentuan
sebelumnya dari Pasal ini. suatu perusahaan asuransi dari suatu Negara Pihak,
kecuali yang berkenaan dengan re-asuransi, akan dianggap mempunyai suatu bentuk
usaha tetap di Negara Pihak lainnya jika perusahaan tersebut memungut premi di
wilayah Negara Pihak lainnya itu atau menanggung resiko yang terjadi disana
melalui seorang pegawai atau melalui suatu perwakilan yang bukan merupakan agen
yang bertindak bebas yang terhadapnya berlaku ketentuan ayat 7
7. Suatu perusahaan dari suatu Negara Pihak
tidak akan dianggap mempunyai suatu bentuk usaha tetap di Negara Pihak lainnya
hanya semata-mata karena perusahaan itu menjalankan usaha di Negara Pihak
lainnya melalui makelar, komisioner umum atau agen lainnya yang bertindak
bebas, sepanjang orang tersebut bertindak dalam rangka kegiatan usahanya yang
lazim. Namun demikian, jika kegiatan-kegiatan agen dimaksud seluruhnya atau
hampir seluruhnya dilakukan atas nama perusahaan itu, maka ia tidak akan
dianggap sebagai agen yang bertindak bebas dalam pengertian dimaksud dalam ayat
ini.
8. Bahwa suatu perusahaan yang merupakan
penduduk suatu Negara Pihak menguasai atau dikuasai oleh suatu perusahaan yang
merupakan penduduk Negara Pihak lainnya, atau yang menjalankan usaha di Negara
Pihak lainnya tersebut (baik melalui suatu bentuk usaha tetap maupun dengan
suatu cara lain), tidak dengan sendirinya mengakibatkan salah satu dari
perusahaan tersebut merupakan bentuk usaha tetap dari perusahaan lainnya,
BAB III
PENERIMAAN PAJAK ATAS
PENGHASILAN
|
Pasal 6 |
1. Penghasilan yang diperoleh seorang
penduduk dari suatu Negara Pihak dari harta tak bergerak, termasuk penghasilan
yang diperoleh dari lahan pertanian atau kehutanan yang berada di Negara Pihak
lainnya, dapat dikenakan pajak di Negara Pihak lainnya tersebut.
2.. Istilah "harta tak bergerak"
mempunyai arti sesuai dengan perundang-undangan Negara Pihak di mana harta yang
bersangkutan berada. Istilah tersebut meliputi benda-benda yang menyertai harta
tak bergerak, ternak dan peralatan yang dipergunakan dalam pertanian dan
kehutanan, hak-hak di mana ketentuan-ketentuan dalam perundang-undangan umurn
mengenai pemilikan atas lahan berlaku, hak pakai hasil atas harta tak gerak
serta hak atas pembayaran-pembayaran tetap ataupun tidak tetap sebagai balas
jasa untuk pekerjaan atau hak untuk mengerjakan bahan-bahan galian,
sumber-sumber dan sumber-sumber daya alam lainnya. Kapal laut dan pesawat udara
tidak dianggap sebagai harta tak bergerak.
3. Ketentuan-ketentuan pada ayat 1 berlaku
juga terhadap penghasilan yang diperoleh dari penggunaan secara langsung, dari
penyewaan, atau dari penggunaan harta tak gerak dalam bentuk apapun
4. Ketentuan-ketentuan pada ayat i dan 3
berlaku pula terhadap penghasilan dari harta tak gerak suatu perusahaan dan

Pasal 7 |
1. Laba suatu perusahaan dan suatu Negara
Pihak hanya akan dikenakan pajak di Negara itu kecuali jika perusahaan itu
menjalankan usaha dl Negara Pihak lainnya melalui suatu bentuk usaha tetap.
Apabila perusahaan tersebut menjalankan usahanya sebagaimana dimaksud di atas,
maka laba perusahaan itu dapat dikenakan pajak di negara lainnya tetapi hanya
atas bagian laba yang berasal dari bentuk usaha tetap tersebut.
2. Tunduk pada ketentuan-ketentuan ayat 3,
jika suatu perusahaan dari suatu Negara Pihak menjalankan usaha di Negara Pihak
lainnya melalui suatu benluk usaha tetap yang berada di sana, maka yang akan
diperhitungkan sebagai laba bentuk usaha tetap itu oleh masing-masing negara
ialah laba yang diperolehnya apabila bentuk usaha tetap tersebut merupakan
suatu perusahaan yang terpisah dan bertindak bebas yang melakukan
kegiatan-kegiatan yang sama atau serupa, dalam keadaan yang sama atau serupa,
dan mengadakan hubungan yang sepenuhnya bebas dengan perusahaan yang memiliki
bentuk usaha tetap tersebut
3. Dalam menentukan besarnya laba suatu
bentuk usaha tetap, dapat dikurangkan biaya-biaya yang dikeluarkan untuk
kepentingan usaha dari bentuk usaha tetap itu, termasuk biaya-biaya pimpinan
dan biaya-biaya administrasi umum, baik yang dikeluarkan di Negara di mana
bentuk usaha tetap itu berada ataupun di tempat lain, sesuai dengan ketentuan
dan tunduk pada batasan hukum pajak Negara tersebut. Namun demikian,
pengurangan tersebut tidak diperkenankan dalam hal pembayaran-pembayaran yang
dilakukan oleh bentuk usaha tetap kepada kantor pusatnya atau kantor-kantor
lain milik kantor pusatnya (selain dari penggantian biaya yang benar-benar
dikeluarkan) berupa royalti, upah atau pembayaran-pembayaran serupa lainnya
karena penggunaan hak paten atau hak-hak lain, atau berupa komisi untuk
jasa-jasa tertentu yang dilakukan atau untuk manajemen atau, kecuali dalam
usaha perbankan, berupa bunga atas pinjaman yang diberikan kepada bentuk usaha
tetap. Sebaliknya, tidak akan diperhitungkan sebagai laba bentuk usaha tetap
adalah jumlah-jumlah yang yang dibebankan oleh bentuk usaha tetap kepada kantor
pusatnya, atau kantor-kantor lain milik kantor pusatnya (selain dari
penggantian biaya yang benar-benar dikeluarkan), berupa royalti, upah atau
pembayaran-pembayaran serupa lainnya karena penggunaan hak paten atau hak-hak
lain, atau berupa Komisi untuk jasa-jasa tertentu yang dilakukan atau untuk
manajemen atau, kecuali dalam usaha perbankan, berupa bunga atas pinjaman yang
diberikan kepada kantor pusatnya atau kantor lain milik kantor pusatnya.
4. Sepanjang merupakan kebiasaan dalam suatu
Negara Pihak untuk menentukan besarnya laba yang dianggap berasal dari bentuk
usaha tetap berdasarkan suatu pembagian secara proporsional atas seluruh laba
perusahaan terhadap bagian-bagiannya, maka ketentuan ayat 2 tidak akan
menghalangi Negara Pihak untuk menentukan besarnya laba yang akan dikenakan
pajak berdasarkan pembagian secara proporsional tersebut seperti yang lazim
digunakan Namun, cara pembagian secara proporsional tersebut harus sedemikian
rupa sehingga hasilnya akan sesuai dengan prinsip-prinsip yang terkandung dalam
Pasal ini.
5. Laba yang semata-mata berasal dari
pembelian barang-barang atau barang dagangan yang dilakukan oleh bentuk usaha
tetap untuk perusahaan tidak akan dihitung sebagai laba dari bentuk usaha
tetap.
6. Untuk tujuan ayat-ayat sebelumnya,
besarnya laba yang dianggap berasal dari bentuk usaha tetap harus ditentukan
dengan cara yang sama dari tahun ke tahun kecuali jika terdapat alasan yang
kuat dan cukup untuk menyimpang
7. Apabila didalam jumlah laba terdapat
penghasilan-penghasilan yang diatur secara tersendiri pada Pasal-Pasal lainnya
dalam Persetujuan ini, maka ketentuan Pasal-Pasal tersebut tidak akan
terpengaruh oleh ketentuan- ketentuan Pasal ini

Pasal 8 |
1. Laba yang diperoleh suatu perusahaan dari
suatu Negara Pihak dari pengoperasian kapal laut atau pesawat udara dalam jalur
lalu lintas internasional hanya akan dapat dikenakan pajak di Negara Pihak di
mana tempat manajemen yang efektif dari perusahaan berada.
2. Jika tempat manajemen yang efektif dari
perusahaan perkapalan berada di atas kapal laut, maka tempat manajemen yang
efektif dianggap berada di Negara Pihak di mana kapal tersebut biasa berlabuh,
atau, dalam hal tidak terdapat pelabuhan semacam itu, tempat manajemen yang
efektif dianggap berada di Negara Pihak di mana operator kapal tersebut menjadi
penduduk.
3. Istilah "pengoperasian kapal-kapal
laut atau pesawal-pesawat udara" diartikan sebagai usaha pengangkutan
penumpang, pos, ternak, atau barang-barang yang diangkut oleh para pemilik atau
para penyewa atau para pencarter kapal-kapal laut atau pesawat-pesawat udara,
termasuk penjualan tiket-tiket untuk pengangkutan demikian atas nama
perusahaan-perusahaan lain, penyewaan kapal-kapal laut dan pesawat-pesawat
udara yang dilakukan sekali-sekali dan kegiatan lainnya yang secara langsung
berhubungan dengan pengangkutan tersebut.
4. Menyimpang dari ketentuan ayat 1 dan 2,
laba yang diperoleh dari suatu Negara Pihak oleh suatu perusahaan pada Negara
Pihak lainnya atas operasi kapal laut dalam jalur lalu lintas internasional
dapat dikenakan pajak di Negara Pihak yang disebutkan pertama, tetapi pajak
yang dikenakan pada Negara Pihak tersebut akan dikurangi dengan 50%.
5, Laba yang berasal dari perusahaan transportasi
yang merupakan penduduk di suatu Negara Pihak atas pemakaian, pemeliharaan,
atau penyewaan peti kemas (termasuk kereta gandeng dan peralatan lainnya untuk
mengangkut peti kemas) yang biasa digunakan untuk untuk mengangkut
barang-barang atau barang dagangan dalam jalur internasional hanya akan
dikenakan pajak di Negara Pihak tersebut, kecuali jika peti kemas tersebut
digunakan semata-mata di dalam Negara Pihak lainnya.
6. Untuk kepentingan Pasal ini, bunga atas
investasi yang terkait langsung dengan pengoperasian kapal-kapal laut atau
pesawat-pesawat udara dalam jalur internasional dianggap sebagai keuntungan
yang berasal dari pengoperasian kapal-kapal taut atau pesawat-pesawat udara
jika merupakan bagian tak terpisahkan dari usaha yang dijalankan, dan
ketentuan-ketentuan Pasal 11 tidak berlaku dalam kaitannya dengan bunga
tersebut,
7. Ketentuan-ketentuan pada ayat 1 berlaku
pula terhadap laba yang diperoleh dari penyertaan dalam suatu gabungan
perusahaan, suatu usaha bersama, atau dalam suatu perwakilan untuk operasi
internasional.

Pasal 9 |
1. Apabila
(a) suatu
perusahaan dari suatu Negara Pihak baik secara langsung maupun tidak langsung
turut serta dalam manajemen, pengawasan atau modal suatu perusahaan di Negara
Pihak lainnya, atau
(b) orang-orang
yang sama baik secara langsung maupun tidak langsung turut serta dalam
manajemen, pengawasan atau modal suatu perusahaan dari Negara Pihak dan suatu
perusahaan dari Negara Pihak lainnya,
dan dalam kedua kasus manapun, kondisi-kondisi yang berlaku
dalam hubungan dagang atau hubungan keuangan antara kedua perusahaan dimaksud
berbeda dengan kondisi-kondisi yang lazimnya berlaku antara
perusahaan-perusahaan yang sama sekali bebas satu sama lain, maka setiap laba
yang seharusnya diperoleh salah satu perusahaan, tetapi dikarenakan
kondisi-kondisi tersebut menjadi tidak ada, dapat ditambahkan pada laba
perusahaan itu dan dikenakan pajak.
2. Apabila suatu Negara Pihak melakukan
pembetulan atas laba suatu perusahaan di Negara itu - dan dikenakan pajak - dan
bagian yang dibetulkan itu adalah juga merupakan laba perusahaan yang telah
dikenakan pajak di Negara Pihak lainnya dan laba tersebut adalah laba yang
memang seharusnya diperoleh perusahaan di Negara yang disebutkan pertama
apabila kondisi-kondisi yang dibuat oleh kedua perusahaan tersebut sama dengan
kondisi-kondisi yang dibuat oleh pihak-pihak yang mempunyai kedudukan bebas,
maka Negara Pihak lainnya akan melakukan penyesuaian-penyesuaian atas jumlah
laba tersebut, terhadap jumlah pajak yang telah dikenakan terhadap laba
tersebut. Dalam melakukan penyesuaian-penyesuaian itu, diharuskan untuk
memperhatikan ketentuan-ketentuan lain dalam Persetujuan ini dan apabila
dinggap perlu pejabat-pejabat yang berwenang dari kedua Negara saling
berkonsultasi.
3. Ketentuan pada ayat 2 tidak berlaku
apabila proses hukum peradilan, administratif atau lainnya telah menghasilkan
keputusan akhir bahwa dengan tindakan menimbulkan penyesuaian laba berdasarkan
ayat 1, salah satu perusahaan bersangkutan dikenakan denda sehubungan dengan
penipuan, kelalaian atau kesalahan yang disengaja
|
Pasal 10 |
1. Dividen yang dibayarkan oleh suatu
perseroan yang merupakan penduduk suatu Negara Pihak kepada penduduk Negara
Pihak lainnya dapat dikenakan pajak di Negara lain tersebut.
2. Namun demikian, dividen tersebut dapat
juga dikenakan pajak di Negara Pihak di mana perseroan yang membayarkan dividen
tersebut menjadi penduduk dan sesuai dengan perundang-undangan Negara tersebut,
akan tetapi apabila penerima manfaat yang menikmati dividen adalah penduduk
Negara Pihak lainnya, maka pajak yang dikenakan tidak akan melebihi 10%
(sepuluh persen) dari jumlah bruto dividen
Ayat ini tidak akan mempengaruhi pengenaan pajak terhadap
perseroan itu atas laba dari mana dividen dibayarkan.
3. Istilah "dividen" sebagaimana
digunakan dalam pasal ini berarti penghasilan dari saham-saham atau hak-hak
lainnya yang bukan merupakan surat-surat piutang, yang berhak atas pembagian
laba, demikian pula penghasilan dan hak-hak perseroan lainnya yang diperlakukan
sama dalam pengenaan pajaknya sebagai penghasilan dari saham-saham oleh perundang
undangan Negara Pihak di mana perusahaan yang membagikan dividen tersebut
berkedudukan.
4. Ketentuan-ketentuan ayat 1 dan 2 tidak
berlaku apabila pemilik saham yang menikmati dividen yang berkedudukan disuatu
Negara Pihak, menjalankan usaha melalui suatu bentuk usaha tetap di Negara
Pihak lainnya di mana perseroan yang membayarkan dividen tersebut berkedudukan,
atau menjalankan pekerjaan bebas di Negara Pihak lainnya meialui suatu tempat
tetap yang berada disana, dan pemilikan saham-saham yang menghasilkan dividen
Itu mempunyai hubungan yang efektif dengan bentuk usaha tetap atau tempat tetap
itu. Dalam hal demikian, tergantung pada permasalahannya, berlaku ketentuan
pasal 7 atau pasal 14.
5. Apabila suatu perseroan yang berkedudukan
di suatu Negara Pihak memperoleh laba atau penghasilan dari Negara Pihak
lainnya. Negara Pihak lainnya tersebut tidak boleh mengenakan pajak apapun juga
atas dividen yang dibayarkan oleh perseroan itu, kecuali apabila dividen itu
dibayarkan kepada penduduk Negara Pihak lainnya tersebut atau apabila
penguasaan saham-saham yang menghasilkan dividen itu mempunyai hubungan yang
efektif dengan bentuk usaha tetap atau tempat tetap yang berada di Negara Pihak
lainnya tersebut, ataupun mengenakan pajak atas laba perseroan yang tidak dibagikan
meskipun dividen yang dibayarkan atau laba yang tidak dibagikan tersebut
seluruhnya atau sebagian berasal dari laba atau penghasilan yang diperoleh di
Negara Pihak lainnya tersebut.

Pasal 11 |
1. Bunga yang berasal dari suatu Negara
Pihak dan dibayarkan kepada penduduk Negara Pihak lainnya dapat dikenakan pajak
di Negara Pihak lainnya tersebut,
2. Namun demikian, bunga tersebut juga dapat
dikenakan di Negara Pihak di mana bunga tersebut berasal sesuai dengan
perundang-undangan di Negara tersebut namun jika pemilik yang menikmati manfaat
dari bunga tersebut merupakan penduduk di Negara Pihak lainnya, pajak yang
dikenakan tidak boleh melebihi 10% (sepuluh persen) dari jumlah bruto bunga
tersebut.
3. Menyimpang dari ketentuan ayat 2, bunga
yang berasal dari Negara Pihak akan dibebaskan dari pengenaan pajak di Negara
tersebut, sepanjang bunga itu diterima dan dinikmati oleh:
(a) Pemerintah,
bagian dari ketatanegaraan atau pemerintah daerah dari Negara Pihak lainnya,
atau
(b) (i) dalam hal Republik Indonesia
(1) Bank Indonesia;
(2) Pusat Investasi Pemerintah; dan
(3) Lembaga Pembiayaan Ekspor Indonesia;
(ii) dalam
hal India:
(1) Reserve Bank of India;
(2) Bank Export-lmport India; dan
(3) National Housing bank, atau
(c) badan
pemerintah atau lembaga lain yang sepenuhnya dimiliki oleh Pemerintah Negara
Pihak, yang disetujui dari waktu ke waktu antara pejabat yang berwenang dari
Negara Pihak;
4, Istilah "bunga" yang digunakan
dalam Pasal ini berarti penghasilan dari semua jenis tagihan utang, baik yang
dijamin dengan hipotik maupun yang tidak dan baik yang mempunyai hak atas
pembagian laba si debitur maupun yang tidak, dan khususnya, penghasilan dari surat-surat
perbendaharaan negara dan penghasilan dari surat-surat obligasi atau
surat-surat utang, termasuk premi dan hadiah yang terikat pada surat-surat
berharga, obligasi atau surat-surat hutang tersebut. Denda atas pembayaran yang
terlambat tidak dianggap sebagai bunga menurut pasal ini
5, Ketentuan-ketentuan ayat 1 dan 2 tidak
akan berlaku apabila pemberi pinjaman yang menikmati bunga berkedudukan di
suatu Negara Pihak, melakukan kegiatan usaha di Negara Pihak lainnya di mana
bunga tersebut berasal melalui suatu bentuk usaha tetap yang berada di sana,
atau menjalankan pekerjaan bebas di Negara Pihak lainnya tersebut. dan tagihan
utang yang menghasilkan bunga Itu mempunyai hubungan yang efektit dengan bentuk
usaha tetap atau tempat tetap itu. Dalam hal demikian tergantung pada
masalahnya, berlaku ketentuan-ketentuan Pasal 7 atau Pasat 14.
6. Bunga dianggap berasal dari suatu Negara
Pihak apabila yang membayar bunga adalah penduduk Negara Pihak itu. Namun
demikian, apabila orang yang membayar bunga itu, tanpa memandang apakah ia
penduduk salah satu Negara Pihak atau tidak, mempunyai bentuk usaha tetap atau
tempat tetap di suatu Negara Pihak di mana bunga dibayarkan, dan bunga itu
menjadi beban bentuk usaha tetap atau tempat tetap tersebut, maka bunga itu
akan dianggap berasal dari Negara Pihak di mana bentuk usaha tetap atau tempat
tetap itu berada.
7. Jika karena adanya hubungan istimewa
antara pembayar bunga dengan pemilik yang menikmati bunga atau antara keduanya
dengan orang lain, dengan memperhatikan besarnya tagihan utang yang
menghasilkan bunga itu, jumlah bunga yang dibayarkan melebihi jumlah yang
seharusnya disetujui antara pembayar dan pemilik yang menikmati bunga
seandainya hubungan istimewa itu tidak ada, maka ketentuan-ketentuan Pasal ini
hanya akan berlaku terhadap jumlah bunga yang disebutkan terakhir. Dalam hal
demikian, jumlah kelebihan pembayaran tersebut akan tetap dikenakan pajak
sesuai dengan perundang-undangan masing-masing Negara, dengan memperhatikan
ketentuan-ketentuan lainnya dalam Persetujuan ini
|
Pasal 12 |
1. Royalti dan upah jasa teknik yang berasal
dari suatu Negara Pihak dan dibayarkan kepada penduduk Negara Pihak laknya
dapat dikenakan pajak di Negara Pihak lainnya tersebut.
2 Namun demikian, royalti dan upah jasa
teknik tersebut dapat juga dikenakan pajak di Negara Pihak di mana royalti itu
berasal, dan sesuai dengan perundang-undangan Negara tersebut, namun apabila
penerima manfaat royalti atau upah jasa teknik tersebut adalah penduduk Negara
Pihak lainnya, maka pajak yang dikenakan tidak akan melebihi 10% (sepuluh
persen) dari jumlah bruto dari royalti atau upah jasa teknik.
3 (a) Istilah
"royalti" sebagaimana digunakan dalam Pasal ini berarti pembayaran
dalam bentuk apapun yang diterima sebagai balas jasa karena penggunaan atau hak
untuk menggunakan, hak cipta kesusasteraan, karya seni atau karya ilmiah,
termasuk film-film sinematografi, atau film-film atau pita-pita yang digunakan
untuk siaran radio atau televisi, paten, merek dagang, pola atau model,
rencana, rumus atau cara pengolahan yang dirahasiakan, atau untuk penggunaan,
atau hak untuk menggunakan, perlengkapan Industri, perniagaan atau ilmu
pengetahuan, atau informasi yang menyangkut pengalaman dibidang industri, perniagaan
atau ilmu pengetahuan.
(b) Istilah "
upah jasa teknik" sebagaimana digunakan dalam Pasal ini berarti pembayaran
dalam bentuk apapun, selain yang disebutkan pada Pasal 14 dan 15 Persetujuan
Ini, yang diterima sebagai balas jasa karena pengelolaan atau teknik atau jasa
konsultasi, termasuk ketentuan jasa teknik atau personil lainnya.
4. Ketentuan-ketentuan ayat 1 dan 2 tidak
berlaku apabila penerima manfaat royalti atau upah jasa teknik, merupakan
penduduk suatu Negara Pihak yang menjalankan usaha di Negara Pihak lainnya di
mana royalti atau upah jasa teknik itu berasal, melalui suatu bentuk tetap yang
berada disana. atau melakukan suatu pekerjaan bebas di Negara Pihak lainnya itu
melalui suatu tempat tetap yang berada disana, dan hak atau milik sehubungan
dengan royalti atau upah jasa teknik yang dibayarkan dan memiliki hubungan yang
efektif dengan bentuk usaha tetap atau tempat tetap itu. Dalam hal demikian,
tergantung pada masalahnya berlaku ketentuan pasal 7 atau pasal 14.
5. (a) Royalti
dan upah jasa teknik dianggap berasal dari Negara Pihak, apabila pembayar
royalti itu adalah Negara Pihak itu sendiri, bagian dari ketatanegaraan,
pemerintah daerah, atau penduduk dari Negara Pihak tersebut Namun demikian,
apabila orang yang membayarkan royalti dan upah jasa teknik itu, tanpa
memandang apakah ia penduduk salah satu Negara Pihak atau tidak, memiliki suatu
bentuk usaha tetap atau tempat tetap disuatu Negara Pihak dalam hubungan mana
kewajiban untuk membayar royalti dan upah jasa teknik itu terjadi, dan royalti
atau upah jasa teknik tersebut menjadi beban bentuk usaha tetap atau tempat
tetap tersebut, maka royalti atau upah jasa teknik tersebut akan dianggap
berasal dari Negara di mana bentuk usaha tetap atau tempat tetap itu berada.
(b) Jika menurut huruf
(a) royalti dan upah jasa teknik tidak berasal dari salah satu Negara Pihak ,
dan royalti terkait dengan penggunaan, atau hak untuk menggunakan, hak atau
milik, atau upah jasa teknik terkait jasa yang dilakukan, di salah satu Negara
Pihak, maka royalti dan upah jasa teknik tersebut dianggap berasal dari Negara
Pihak itu.
6, Jika karena adanya hubungan Istimewa
antara pembayar royalti dengan penerima manfaat atau antara kedua-duanya dengan
orang, jumlah royalti dan upah jasa teknik yang dibayarkan, dengan
memperhatikan pemakaian, hak atau keterangan untuk mana royalti itu dibayar
melebihi jumlah yang seharusnya disepakati oleh pembayar dengan penerima
manfaat, seandainya hubungan istimewa tersebut tidak ada, maka
ketentuan-ketentuan dalam Pasal Ini hanya berlaku atas jumlah royalti yang
disebut kemudian. Dalam hal demikian, jumlah kelebihan pembayaran tersebut akan
tetap dikenakan pajak sesuai dengan perundang-undangan masing-masing Negara
Pihak, dengan memperhatikan ketentuan-ketentuan lain dalam Persetujuan ini.

Pasal 13 |
1. Keuntungan yang diperoleh penduduk suatu
Negara Pihak dari pemindahtanganan harta tak gerak sebagaimana dimaksud dalam
Pasal 6 dan terletak di Negara Pihak lainnya, dapat dikenakan pajak di Negara
Pihak lainnya tersebut.
2. Keuntungan dari pemindahtanganan harta
gerak yang merupakan bagian kekayaan suatu bentuk usaha tetap yang dimiliki
oleh perusahaan dari Negara Pihak di Negara Pihak lainnya atau dari harta
bergerak yang merupakan bagian dari suatu tempat tetap yang tersedia bagi
penduduk suatu Negara Pihak di Negara Pihak lainnya untuk maksud melakukan
pekerjaan bebas, termasuk keuntungan dari pemindahtanganan bentuk usaha tetap
itu (terpisah atau beserta keseluruhan perusahaan) atau tempat tetap, dapat
dikenakan pajak di Negara lainnya tersebut.
3. Keuntungan yang diperoleh perusahaan
suatu Negara Pihak dari pemindahtanganan kapal laut atau pesawat udara yang
beroperasi di jalur lalu lintas internasional atau harta bergerak yang menjadi
bagian dari operasi kapal laut atau pesawat udara hanya dapat dikenakan pajak
di Negara Pihak tersebut di mana tempat kedudukan manajemen yang efektif dari
perusahaan tersebut berada.
4. Keuntungan yang diperoleh penduduk suatu
Negara Pihak dari pemindahtanganan atas saham-saham perseroan yang lebih dari
50 persen dari nilai kekayaannya secara langsung atau tidak langsung berasal
dari harta tak gerak yang berada di Negara Pihak lainnya dapat dikenakan pajak
di Negara Pihak lainnya tersebut.
5. Keuntungan dari pemindahtanganan saham
selain yang disebutkan dalam ayat 4 di sebuah perseroan yang merupakan penduduk
suatu Negara Pihak dapat dikenakan pajak di Negara tersebut.
6. Keuntungan dari pemindahtanganan harta
selain dari yang telah disebutkan pada ayat 1, 2, 3, 4 dan 5 hanya akan
dikenakan pajak di Negara Pihak di mana yang melakukan pemindahtanganan
berkedudukan.

Pasal 14 |
1. Penghasilan yang diperoleh individu yang
merupakan penduduk dari suatu Negara Pihak sehubungan dengan pekerjaan bebas
yang dilakukan atau kegiatan-kegiatan lainnya yang serupa, hanya akan dikenakan
pajak di Negara tersebut, kecuali dalam hal tersebut dibawah ini, di mana
penghasilan itu dapat juga dikenakan pajak di Negara Pihak lainnya :
(a) apabila ia
mempunyai suatu tempat tetap yang tersedia secara teratur baginya untuk
menjalankan kegiatan-kegiatan di Negara Pihak lainnya itu; dalam hal demikian,
penghasilan yang dikenakan pajak di Negara Pihak lainnya itu hanyalah atas
bagian penghasilan yang dianggap berasal dari tempat tetap tersebut; atau
(b) apabila ia
tinggal di Negara Pihak lainnya dalam satu masa atau masa-masa yang jumlahnya
melebihi 91 hari dalam masa dua belas bulan; dalam hal demikian, hanya atas
penghasilan yang diperoleh dari kegiatan-kegiatan yang dilakukan di Negara
Pihak lainnya itu yang dapat dikenakan pajak di Negara lainnya tersebut.
2. Istilah "jasa-jasa profesional"
meliputi pekerjaan bebas dibidang ilmu pengetahuan, kesusasteraan, kesenian,
kegiatan pendidikan maupun pengajaran, demikian juga pekerjaan-pekerjaan bebas
oleh para dokter, ahli hukum, ahli tehnik, arsitek, dokter spesialis bedah,
dokter gtgi dan akuntan.

Pasal 15 |
1. Dengan memperhatikan ketentuan-ketentuan
Pasal 16, 18, 19 dan 20, gaji, upah dan imbalan lainnya yang serupa yang
diperoleh penduduk suatu Negara pihak teima terkait pekerjaan dalam hubungan
kerja, hanya akan dikenakan pajak di Negara itu, kecuali pekerjaan tersebut
dilakukan di Negara Pihak lainnya. Dalam hal demikian, maka imbalan yang
diterima dari pekerjaan dimaksud dapat dikenakan pajak di Negara Pihak lainnya.
2. Menyimpang dari ketentuan ayat 1, imbalan
yang diterima atau diperoleh penduduk dari suatu Negara Pihak dari pekerjaan
yang dilakukan di Negara Pihak lainnya, hanya akan dikenakan pajak di Negara
yang disebut pertama, apabila:
(a) penerima
imbalan berada di Negara Pihak lainnya itu dalam suatu masa atau masa-masa yang
jumlahnya tidak melebihi 183 hari dalam masa dua belas bulan yang dimulai atau
berakhir di periode pajak yang terkait; dan
(b) imbalan itu
dibayarkan oleh, atau atas nama pemberi kerja yang bukan merupakan penduduk
Negara Pihak lainnya tersebut; dan
(c) imbalan itu
tidak menjadi beban bentuk usaha tetap atau tempat tetap yang dimiliki oleh
pemberi kerja di Negara Pihak lainnya tersebut.
3. Menyimpang dari ketentuan-ketentuan
sebelumnya dalam Pasal ini. imbalan yang diperoleh sehubungan dengan pekerjaan
yang dilakukan di atas kapat laut atau pesawat udara yang dioperasikan dalam
jalur lalu lintas internasional, dapat dikenakan pajak di Negara Pihak di mana
tempat manajemen yang efektif dari perusahaan tersebut berada.

Pasal 16 |
Imbalan-imbalan para
direktur dan pembayaran-pembayaran serupa yang diperoleh penduduk Negara Pihak
dalam kedudukannya sebagai anggota dewan komisaris maupun jabatan yang serupa
dari perusahaan yang berkedudukan di suatu Negara Pihak lainnya dapat dikenakan
pajak di Negara Pihak lainnya tersebut.

Pasal 17 |
1. Menyimpang dari ketentuan-ketentuan
pasal-pasal 14 dan 15, penghasilan yang diperoleh penduduk suatu Negara Pihak
sebagai artis, seperti artis teater, film, radio atau televisi, atau pemain
musik, atau sebagai atlit, dari kegiatan-kegiatan pribadinya yang dilakukan di
Negara Pihak lainnya, dapat dikenakan pajak di Negara lainnya tersebut.
2 Apabila penghasilan sehubungan dengan
kegiatan-kegiatan pribadi yang dilakukan oleh artis atau allit dalam
kapasitasnya tersebut diterima bukan oleh artis atau atlit itu sendiri tetapi
oleh orang lain, Menyimpang dari ketentuan-ketentuan pada Pasal-pasal 7, 14,
dan 15, maka penghasilan tersebut dapat dikenakan pajak di Negara Pihak di mana
kegiatan-kegiatan artis atau allit itu dilakukan.
3 Ketentuan-ketentuan pada ayat 1 dan 2
tidak diterapkan terhadap penghasilan dari kegiatan-kegiatan yang dijalankan
oleh artis atau atlit di Negara Pihak jika kunjungan ke Negara Pihak tersebut
didukung dana pemerintah salah satu atau kedua Negara Pihak atau pemerintah
daerahnya atau lembaga pemerintahannya. Dalam hal demikian, penghasilan tersebut
hanya akan dikenakan pajak di Negara Pihak di mana pekerja seni atau atlet
tersebut merupakan penduduk.

Pasal 18 |
1. Berdasarkan ketentuan-ketentuan Pasal 19
ayat 2, pensiun dan tunjangan serupa lainnya yang dibayarkan sebagai balas jasa
atas pekerjaan terdahulu sebagai karyawan dan tunjangan hari tua yang
dibayarkan kepada penduduk suatu Negara Pihak, hanya akan dikenakan pajak di
Negara Pihak tersebut.
2. Istilah "tunjangan hari tua"
berarti suatu jumlah tertentu yang dibayarkan secara berkala dalam waktu
tertentu selama hidup atau selama suatu masa atau jangka waktu tertentu,
berdasarkan suatu kewajiban untuk melakukan pembayaran sebagai penggantian
balas jasa yang memadai dan penuh dalam bentuk uang atau yang dapat dinilai
dengan uang.

Pasal 19 |
1. (a) Gaji, upah dan imbalan serupa lainnya, selain pensiun, yang
dibayarkan oleh Negara Pihak, atau bagian ketatanegaraannya, atau pemerintah
daerahnya/kepada individu sehubungan dengan jasa-jasa yang diberikan kepada
Negara tersebut atau bagian ketatanegaraannya atau otoritasnya hanya akan
dikenakan pajak di Negara tersebut;
(b) Namun demikian,
gaji, upah dan imbalan serupa lainnya tersebut hanya akan dikenakan pajak di
Negara Pihak lainnya jika jasa-jasa tersebut diberikan di Negara pihak lainnya
tersebut dan individu yang memberikan jasa tersebut adalah penduduk Negara
Pihak lainnya itu yang :
(i) merupakan
warganegara dari Negara itu, atau
(il) tidak
menjadi penduduk Negara itu semata-mata hanya untuk maksud memberikan jasa-jasa
tersebut
2. (a) Pensiun
yang dibayarkan oleh, atau dari dana yang dlbentuk oleh suatu Negara Pihak atau
bagian ketatanegaraannya atau pemerintah daerahnya kepada individu sehubungan
dengan Jasa-jasa yang diberikannya kepada Negara tersebut hanya akan dikenakan
pajak di Negara lersebut.
(b) Namun demikian,
pensiun tersebut hanya dapat dikenakan pajak di Negara Pihak lainnya jika
individu tersebut adalah penduduk dan warganegara dari Negara Pihak lainnya
tersebut.
3. Ketentuan-ketentuan dalam Pasal 15, 16,
17 dan 18 berlaku atas gaji, upah, dan Imbalan serupa lainnya, dan pensiun
sehubungan dengan jasa-jasa yang diberikan yang terkait dengan usaha yang
dijalankan oleh Negara Pihak atau bagian ketatanegaraannya atau pemerintah
daerahnya.

Pasal 20 |
1. Dosen, guru atau peneliti yang menjadi
penduduk atau pernah menjadi penduduk salah satu Negara Pihak sebelum melakukan
kunjungan ke Negara Pihak lainnya untuk mengajar atau melakukan penelitian,
atau kedua-duanya, pada universitas, akademi, sekolah, musium, atau lembaga
pendidikan yang di akui lainnya di Negara Pihak lain itu, akan dibebaskan dari
pengenaan pajak di Negara Pihak lainnya itu atas setiap balas jasa yang
diperoleh dari mengajar atau dari penelitian untuk masa yang tidak melebihi dua
tahun sejak tanggal kedatangannya di Negara Pihak lain tersebut,
2. Pasal ini tidak berlaku atas penghasilan
yang diperoleh dari penelitian apabila penelitian tersebut dilakukan terutama
untuk kepentingan seseorang atau orang-orang tertentu.
3, Untuk kepentingan Pasal ini, seseorang
dianggap sebagai penduduk suatu Negara Pihak apabila ia menjadi penduduk Negara
Pihak itu dalam tahun diperolehnya penghasilan di mana ia melakukan kunjungan
ke Negara Pihak lainnya atau dalam tahun sebelumnya dari tahun perolehan
penghasilan,
4, Untuk kepentingan ayat 1, Istilah
"lembaga pendidikan yang diakui" berarti suatu lembaga yang telah
disahkan oleh pejabat berwenang di Negara Pihak yang bersangkutan.

Pasal 21 |
1. Pembayaran-pembayaran yang diterima oleh
siswa atau pemagang yang sebelum melakukan kunjungan ke Negara Pihak merupakan
penduduk dari Negara Pihak lainnya dan yang berada di Negara yang disebutkan
pertama bertujuan semata-mata untuk mengikuti pendidikan atau magang, yang
diterima semata-mata untuk keperluan hidup, pendidikan, atau magang tidak akan
dikenakan pajak di Negara yang disebutkan pertama tersebut, sepanjang
pembayaran-pembayaran tersebut timbul dari sumber di luar Negara lereebut.
2. Manfaat dan Pasal ini hanya akan
diberikan untuk suatu jangka waktu yang wajar atau menurut kebiasaan diperlukan
untuk menyelesaikan pendidikan atau latihan tersebut, tetapi setiap individu
dalam keadaan apapun tidak akan mernperoleh manfaat dari Pasal ini:
(i) dalam hal
siswa untuk masa yang melebihi 5 tahun berturut turut sejak tanggal
kedatangannya untuk tujuan pendidikannya di Negara Pihak tersebut;
(ii) dalam hal
pemagang: untuk masa yang melebihi 2 tahun berturut turut sejak tanggal
kedatangannya untuk tujuan pemagangannya di Negara Pihak tersebut.

Pasal 22 |
1. Jenis-jenis penghasilan yang diperoleh
penduduk Negara Pihak, dari manapun asalnya yang tidak disebut di Pasal-pasal
terdahulu dalam Persetujuan Ini hanya akan dikenakan pajak di Negara Pihak
tersebut.
2. Ketentuan-ketentuan ayat 1 tidak akan
berlaku terhadap penghasilan, selain penghasilan dari pemindahtanganan harta
tak gerak sebagaimana disebutkan dalam pasal 6 ayat 2, apabila penerima
penghasilan adalah penduduk suatu Negara Pihak, yang menjalankan usahanya di
Negara Pihak lainnya melalui suatu bentuk usaha retap yang berada disana, atau
melakukan pekerjaan bebas di Negara Pihak lainnya itu melalui suatu tempat
tatap yang berada disana, dan hak atau harta sehubungan dengan penghasilan itu
dibayarkan, mempunyai hubungan efektif dengan bentuk usaha tetap atau tempat
tetap itu. Dalam hal demikian, tergantung pada masalahnya, berlaku ketentuan-
ketentuan Pasal 7 atau Pasal 14.
3. Menyimpang dari ketentuan-ketentuan ayat
1 dan 2, bagian-bagian penghasilan penduduk suatu Negara Pihak yang tidak
disebut di Pasal-pasal sebelumnya dalam Persetujuan Ini dan berasal dari Negara
Pihak lainnya dapat juga dikenakan pajak di Negara Pihak lainnya tersebut
BAB IV
METODE-METODE UNTUK
ELIMINASI PAJAK BERGANDA
|
Pasal 23 |
1. Apabila penduduk suatu Negara Pihak
memperoleh penghasilan yang sesuai dengan ketentuan-ketentuan dalam Persetujuan
ini, dapat dikenakan pajak di Negara Pihak iainnya. Negara yang disebutkan
pertama akan memperbolehkan pengurangan dalam jumlah yang sepadan dengan pajak
penghasilan yang dibayarkan di Negara Pihak lainnya dari pajak atas penghasilan
penduduk tersebut di Negara yang disebutkan pertama. Namun demikian,
pengurangan tersebut tidak diperkenankan melebihi jumlah pajak penghasilan yang
diperhitungkan sebelum diberikannya pengurangan yang terkait tersebut sesuai
dengan keadaannya, terhadap penghasilan yang dapat dikenakan pajak di Negara
Pihak lainnya.
2. Sesuai dengan ketentuan dalam Persetujuan
ini, apabila penghasilan yang diperoleh penduduk suatu Negara Pihak dibebaskan
dari pajak di Negara tersebut, dalam menghitung jumlah pajak atas sisa
penghasilan dari penduduk tersebut, Negara tersebut diperbolehkan
memperhitungkan penghasilan yang dibebaskan.
BAB V
KETENTUAN - KETENTUAN
KHUSUS
|
Pasal 24 |
1, Ketentuan-ketentuan dalam Persetujuan ini
dilakukan tidak untuk mencegah Suatu Negara Pihak dalam menerapkan
ketentuan-ketentuan Perundang-undangan nasionalnya dan tindakan untuk mencegah
penghindaran pajak maupun pengelakan pajak baik yang digambarkan secara jelas
maupun tidak
2 Penduduk suatu Negara Pihak tidak berhak
atas manfaat-manfaat dari persetujuan ini jika penerapan ketentuan-ketentuan
dalam persetujuan ini dilakukan untuk kepentingan yang telah diatur sedemikian
rupa sehingga seolah-olah merupakan tujuan utama atau salah satu tujuan
utamanya adalah untuk mendapatkan manfaat dari Persetujuan ini
3, Dalam hal badan hukum tidak memiliki
aktivitas usaha yang dapat dipercaya kebenarannya, dianggap tercakup oleh
ketentuan ketentuan dalam Pasal ini.
|
Pasal 25 |
1. Warganegara dari suatu Negara Pihak tidak
akan dikenakan pajak atau kewajiban apapun yang berkailan dengan pengenaan
pajak di Negara Pihak lainnya yang berlainan atau lebih memberatkan daripada
pengenaan pajak dan kewajiban-kewajiban terkait, yang dikenakan atau dapat
dikenakan terhadap Warganegara dari Negara Pihak lainnya dalam keadaan yang
sama, khususnya yang berkaitan dengan kewarganegaraan, Menyimpang dari
ketentuan Pasal 1, juga berlaku juga bagi orang yang bukan penduduk salah satu
atau kedua Negara Pihak.
2. Pengenaan Pajak atas bentuk usaha tetap
yang dimiliki oleh suatu perusahaan dari Negara Pihak di Negara Pihak lainnya,
tidak dapat dilakukan dengan cara yang kurang menguntungkan dibandingkan dengan
pengenaan pajak atas perusahaan-perusahaan yang menjalankan kegiatan-kegiatan
yang sama di Negara Pihak lainnya itu. Ketentuan ini tidak dapat ditafsirkan
sebagai mewajibkan suatu Negara Pihak untuk memberikan kepada penduduk Negara
Pihak lainnya suatu potongan pribadi, keringanan-keringanan dan pengurangan-pengurangan
untuk kepentingan pengenaan pajak berdasarkan status sipil atau tanggung jawab
keluarga seperti yang diberikan kepada penduduknya sendiri.
3. Perusahaan dari suatu Negara Pihak, yang
modalnya sebagian atau seluruhnya dimiliki atau dikuasai baik langsung maupun
tidak langsung oleh satu atau lebih penduduk dari Negara Pihak lainnya, tidak
akan dikenakan pajak atau kewajiban apapun yang berkaitan dengan pengenaan
pajak tersebut di Negara yang disebutkan pertama yang berlainan atau lebih
memberatkan dibandingkan dengan pengenaan pajak dan kawajiban-kewajiban terkait
yang dikenakan atau dapat dikenakan terhadap perusahaan-perusahaan lainnya yang
serupa di Negara yang disebutkan pertama.
4. Kecuali apabila ketentuan-ketentuan Pasal 9
ayat 1, Pasal 11 ayat 7, atau Pasal 12 ayat 6 berlaku, bunga, royalti, dan
pengeluaran-pengeluaran yang dibayarkan oleh perusahaan dari Negara Pihak
kepada penduduk Negara Pihak lainnya untuk tujuan menentukan laba yang dapat
dikenakan pajak atas perusahaan tersebut, akan dapat dikurangkan berdasarkan
kondisi yang sama apabila pembayaran tersebut dibayarkan kepada penduduk Negara
yang disebutkan pertama.
5. Yang dimaksud dengan istilah
"perpajakan" dalam Pasal ini adalah pajak-pajak sebagaimana dimaksud
dalam Persetujuan ini.
|
Pasal 26 |
1. Apabila seseorang menganggap bahwa
tindakan-tindakan salah satu atau kedua Negara Pihak mengakibatkan atau akan
mengakibatkan pengenaan pajak yang tidak sesuai dengan Persetujuan ini, maka
terlepas dari cara-cara penyelesaian yang diatur oleh perundang-undangan
nasional dari masing-masing Negara, ia dapat mengajukan masalahnya kepada
pejabat yang berwenang di Negara Pihak di mana ia menjadi penduduk Negara itu
atau, jika masalah yang timbul terkait dengan Pasal 25 ayat 1, kepada Negara
Pihak di mana ia menjadi warganegara. Masalah tersebut harus diajukan dalam
waktu tiga tahun sejak tanggal diterimanya pemberitahuan mengenai tindakan yang
menimbulkan pengenaan pajak yang tidak sesuai dengan Persetujuan ini.
2. Apabila keberatan yang diajukan itu cukup
beralasan dan apabila atas masalah tersebut tidak dapat menemukan suatu
penyelesaian yang memuaskan, pejabat yang berwenang harus menyelesaikan masalah
itu melalui persetujuan bersama dengan pejabat yang berwenang dari Negara Pihak
lainnya, dengan maksud untuk menghindari pengenaan pajak yang tidak sesuai
dengan Persetujuan ini Setiap Persetujuan yang telah disepakati akan
diterapkan, terlepas dari batas waktu yang ada dalam perundang-undangan
nasional dikedua Negara Pihak.
3. Pejabat-pejabat yang berwenang dari kedua
Negara Pihak akan berusaha untuk menyelesaikan setiap kesulitan atau
keragu-raguan yang timbul dalam penafsiran atau penerapan Persetujuan ini
melalui suatu Persetujuan bersama Mereka dapat juga berkonsultasi satu sama
lain untuk mencegah pengenaan pajak berganda dalam hal-hal yang tidak diatur
daiam Persetujuan ini.
4. Pejabat-pejabat yang berwenang dari kedua
Negara Pihak dapat herhubungan langsung satu sama lain untuk mencapai
Persetujuan sebagaimana dimaksud pada ayat-ayat sebelumnya. Para pejabat yang
berwenang, melalui konsultasi, akan mengembangkan prosedur grosodur bilateral,
kondisi kondisi, metode-metode dan teknik-teknik yang untuk melaksanakan
prosedur persetujuan bersama yang disediakan dalam Pasal ini
|
Pasal 27 |
1. Para Pejabat yang berwenang dari Negara
Pihak akan melakukan pertukaran informasi (termasuk dokumen-dokumen dan salinan
resmi dokumen-dokumen) yang dipandang relevan untuk melaksanakan
ketentuan-ketentuan dalam Persetujuan ini atau untuk melaksanakan administrasi
atau penegakan hukum dalam perundang-undangan domestik Negara Pihak, atau
bagian ketatanegaraannya atau pemerintah daerahnya tersebut yang berkaitan
dengan pajak-pajak yang dicakup dalam Persetujuan ini, sepanjang pengenaan
pajak tersebut tidak bertentangan dengan Persetujuan ini. Pertukaran informasi
ini tidak dibatasi dengan Pasal 1 dan pasal 2.
2. Setiap informasi yang diterima
sebagaimana dimaksud pada ayat 1 oleh Negara Pihak harus dijaga kerahasiaannya
dengan cara yang sama seperti apabila informasi itu diperoleh berdasarkan
perundang-undangan domestik Negara tersebut dan hanya boleh diungkapkan kepada
orang-orang atau pihak-pihak berwenang (termasuk pengadilan dan badan-badan
administratif) yang berkepentingan dalam penetapan atau penagihan, penegakan
hukum atau penuntutan, atau dalam memutuskan keberatan yang terkait dengan
pajak-pajak sebagaimana dimaksud dalam ayat 1, atau pengawasan tersebut di
atas. Orang-orang atau pihak-pihak berwenang tersebut hanya boleh menggunakan
informasi tersebut untuk tujuan-tujuan tersebut di atas. Mereka boleh
mengungkapkan informasi tersebut dalam proses pengadilan atau dalam pembuatan
keputusan pengadilan.
3. Ketentuan-ketentuan pada ayat 1 dan ayat
2 tidak dimaksudkan untuk ditafsirkan untuk membebani Negara Pihak kewajiban:
(a) melaksanakan
tindakan-tindakan administratif yang bertentangan dengan perundang-undangan
atau praktek administrasi yang berlaku di Negara tersebut atau di Negara Pihak
lainnya;
(b) memberikan
informasi (termasuk dokumen-dokumen dan salinan resmi dokumen-dokumen) yang
tidak mungkin diperoleh berdasarkan perundang-undangan atau dalam praktek
administrasi yang lazim di Negara tersebut atau di Negara Pihak lainnya.
(c) memberikan
informasi yang mengungkapkan rahasia apapun di bidang perdagangan, usaha,
industri, perniagaan atau keahlian atau tata cara perdagangan atau informasi
lainnya yang pengungkapannya bertentangan dengan kebijakan publik (ketertiban
umum).
4. Apabila informasi yang diminta oleh
Negara Pihak memenuhi ketentuan-ketentuan yang diatur dalam Pasal ini, Negara
Pihak lainnya harus menggunakan tindakan-tindakan pengumpulan informasi untuk
memperoleh Informasi yang diminta tersebut, meskipun Negara Pihak lainnya
tersebut tidak memerlukan informasi dimaksud untuk tujuan perpajakannya
sendiri, Kewajiban yang terkandung dalam kalimat sebelum ini harus
memperhatikan pembatasan dalam ayat 3 namun sama sekali tidak akan ditafsirkan
untuk memperbolehkan Negara Pihak untuk menolak memberikan informasi semata-
mata karena Negara Pihak tersebut tidak memiliki kepentingan domestik atas
informasi yang diminta tersebut.
5. Terhadap kondisi apapun
ketentuan-ketentuan pada ayat 3 sama sekali tidak dapat ditafsirkan
memperbolehkan Negara Pihak untuk menolak memberikan informasi karena informasi
yang diminta tersebut dimiliki oleh bank, lembaga keuangan lainnya, nominee
orang yang bertindak sebagai agen atau kapasitas fidusier atau karena informasi
yang diminta tersebut berkaitan dengan kepentingan kepemilikan di suatu badan.
|
Pasal 28 |
1. Para Negara Pihak harus memberikan
bantuan satu sama lain dalam melakukan penagihan pajak. Bantuan ini tidak
dibatasi oleh Pasal 1 dan 2. Pejabat-pejabat yang berwenang dari Negara Pihak.
melalui persetujuan bersama dapat menentukan metode penerapan Pasal ini.
2. Istilah "tagihan pajak" seperti
yang digunakan dalam Pasal ini berarti sejumlah utang atas seluruh jenis dan
deskripsi pajak yang dikenakan atas nama Negara Pihak, atau bagian-bagian
ketatanegaraan atau pemerintah-pemerintah daerahnya, sepanjang pemajakan yang
dilakukan tidak bertentangan dengan Persetujuan ini atau instrumen lainnya di
mana Negara Pihak menjadi pihak, termasuk bunga, denda administrasi dan biaya
penagihan atau pemeliharaan yang terkait dengan dengan jumlah utang.
3. Apabila tagihan pajak suatu Negara Pihak
dapat dilaksanakan berdasarkan hukum Negara Pihak tersebut dan terutang oleh
orang pada saat itu, berdasarkan hukum Negara Pihak tersebut, tidak dapat
menghindar dari penagihan tersebut, maka tagihan pajak, berdasarkan permintaan oleh
pejabat berwenang dari Negara Pihak itu, harus diterima untuk dilakukan
penagihan oleh pejabat berwenang dari Negara Pihak lainnya. Penagihan pajak
tersebut harus dilakukan oleh Negara Pihak lainnya tersebut sesuai dengan
ketentuan- ketentuan yang berlaku di negaranya untuk pelaksanaan dan penagihan
pajak seolah-olah tagihan pajak tersebut merupakan tagihan pajak Negara Pihak
lainnya tersebut.
4. Apabila suatu tagihan pajak suatu Negara
Pihak adalah tagihan yang mana Negara Pihak tersebut, berdasarkan ketentuan
perundang-undangannya, dapat mengambil tindakan perlindungan dengan maksud
untuk memastikan penagihannya, tagihan pajak tersebut, atas permintaan pejabat
berwenang dari Negara Pihak tersebut, harus diterima untuk tujuan mengambil
tindakan perlindungan oleh pejabat berwenang dari Negara Pihak lainnya. Negara
Pihak lainnya tersebut harus mengambil tindakan perlindungan sehubungan dengan
tagihan pajak tersebut sesuai dengan ketentuan perundang-undangan yang berlaku
seolah-olah tagihan pajak tersebut merupakan tagihan pajak Negara Pthak lainnya
tersebut bahkan jika, pada saat tindakan tersebut dilakukan, tagihan pajak
tidak dapat dilaksanakan di Negara Pihak yang disebutkan pertama atau terutang
oleh orang yang memiliki hak untuk menghindari diri dari penagihan pajak
tersebut.
5. Menyimpang dari kelentuan-ketentuan ayat
3 dan 4, suatu tagihan pajak yang diterima oleh suatu Negara Pihak untuk tujuan
ayat 3 atau 4 tidak tunduk pada batas waktu atau diberikan prioritas yang
berlaku untuk tagihan pajak berdasarkan ketentuan perundang-undangan Negara
Pihak tersebut. Selain itu, untuk tujuan ayat 3 dan 4, tagihan pajak yang
diterima oleh suatu Negara Pihak, tidak memiliki prioritas yang berlaku
terhadap tagihan pajak tersebut berdasarkan Perundang-undangan Negara Pihak
lainnya
6. Tuntutan perkara sehubungan dengan
keberadaan, keabsahan atau jumlah tagihan pajak suatu Negara Pihak hanya dapat
diajukan di pengadilan atau badan administrasi Negara Pihak tersebut. Ketentuan
dalam Pasal ini tidak maksudkan untuk ditafsirkan untuk membuat atau
menyediakan hak untuk proses tersebut ke pengadilan atau badan administrasi
Negara Pihak lainnya.
7. Apabila, sewaktu-waktu setelah suatu
permintaan dibuat oleh Negara Pihak berdasarkan ayat 3 atau 4 dan sebelumnya,
Negara Pihak lainnya lelah melakukan penagihan dan penyetoran tagihan pajak
terkait ke Negara Pihak yang disebutkan pertama, tagihan pajak bukan lagi:
(a) dalam hal suatu
permintaan berdasarkan ketentuan ayat 3, suatu tagihan pajak Negara Pihak yang
disebutkan pertama yang dapat dilaksanakan berdasarkan ketentuan
perundang-undangan Negara tersebut dan terutang oleh seseorang yang pada saat
itu berdasarkan ketentuan perundang-undangan Negara itu tidak dapat menghindar
dari penagihan tersebut, atau
(b) dalam hal sualu
permintaan berdasarkan ketentuan ayat 4, suatu tagihan pajak Negara Pihak yang
disebutkan pertama, yang berdasarkan ketentuan perundang-undangan Negara Pihak
tersebut, Negara tersebut dapat mengambil tindakan perlindungan dengan maksud
untuk memastikan penagihan pajak tersebut
pejabat yang berwenang dari Negara Pihak yang disebutkan
pertama harus segera memberitahukan pejabat yang berwenang Negara Pihak lainnya
mengenai fakta tersebut dan, atas pilihan Negara Pihak lainnya, Negara Pihak
yang disebutkan pertama harus menangguhkan ataupun menarik kembali
permintaannya.
8. Ketentuan-ketentuan Pasal ini tidak
dimaksudkan untuk membebani Negara Pihak kewajiban:
(a) untuk
melaksanakan tindakan-tindakan administratif yang bertentangan dengan Undang-Undang
dan praktik administrasi Negara Pihak itu atau Negara Pihak lainnya;
(b) melaksanakan
tindakan-tindakan yang mungkin bertentangan dengan kebijakan publik (ketertiban
umum);
(c) untuk
memberikan bantuan jika Negara Pihak lainnya tidak melakukan tindakan penagihan
atau pengamanan yang layak, yang tersedia berdasarkan perundang-undangannya;
(d) untuk
memberikan bantuan dalam kasus-kasus di mana beban
administrasi bagi Negara Pihak tersebut jelas tidak sebanding dengan manfaat
yang akan diperoleh Negara Pihak lainnya.

Pasal 29 ANGGOTA MISI DIPLOMATIK DAN KONSULER |
Persetujuan ini tidak akan mempengaruhi hak-hak
istimewa di bidang fiskal dari anggota misi diplomatik atau konsuler
berdasarkan peraturan-peraturan umum hukum internasional atau berdasarkan
ketentuan-ketentuan dalam suatu persetujuan khusus.
BAB VI
KETENTUAN - KETENTUAN
AKHIR
|
Pasal 30 BERLAKUNYA PERSETUJUAN |
1. Masing-masing Negara Pihak akan
memberitahukan kepada Negara Pihak lainnya melalui saluran diplomatik mengenai
penyelesaian tatacara yang dipersyaratkan berdasarkan perundang- undangannya
untuk memberlakukan Persetujuan ini.
2. Persetujuan ini mulai berlaku pada
tanggal terakhir dilakukannya pemberitahuan sebagaimana dimaksud dalam ayat 1
Pasal ini.
3. Ketentuan-ketentuan Persetujuan ini akan
berlaku efektif sebagai berikut :
(a) Di
Indonesia:
(i) sehubungan dengan pajak yang dipotong pada
sumbernya: untuk jumlah yang dibayarkan atau dikreditkan pada atau setelah hari
pertama bulan Januari tahun berikutnya setelah Persetujuan ini diberlakukan;
dan
(ii) sehubungan dengan pajak-pajak lainnya:
untuk setiap tahun pajak yang dimulai pada atau setelah hari pertama bulan
Januari tahun berikutnya setelah Persetujuan ini diberlakukan.
(b) Di India, sehubungan dengan penghasilan
yang diperoleh pada tahun pajak, yang dimulai pada atau setelah tanggal 1 April
tahun takwim berikutnya setelah persetujuan diberlakukan.
4 Persetujuan antara Pemerintah Republik
Indonesia dan Pemerintah Republik India untuk Penghindaran Pengenaan Pajak
Berganda dan Pencegahan Pengelakan Pajak yang berhubungan dengan pajak-pajak
atas penghasilan yang ditandatangani di Jakarta pada tanggal 7 Agustus 1987
tidak akan berlaku sejak Persetujuan ini berlaku efektif sesuai ketentuan pada
ayat 3 Pasal ini.

Pasal 31 BERAKHIRNYA PERSETUJUAN |
Persetujuan ini akan tetap
berlaku sampai dengan dilakukannya terminasi oleh salah satu Negara Pihak,
Masing-masing Negara Pihak dapat mengakhiri atas Persetujuan ini, melalui
saluran-saluran diplomatik, dengan menyampaikan pemberitahuan tertulis tentang
pengakhiran tersebut paling lambat enam bulan sebelum akhir tahun, dimulai
setelah berakhirnya jangka waktu lima tahun sejak berlakunya Persetujuan ini
Dalam hal demikian, Persetujuan ini akan tidak berlaku lagi:
(a) Di Indonesia.
(i) sehubungan dengan pajak-pajak yang
dipotong/pungut: untuk jumlah yang dibayar atau dikreditkan pada atau setelah
tanggal 1 Januari di tahun kalender berikutnya dari tanggal disampaikannya
permberitahuan pengakhiran tersebut, dan
(ii) sehubungan dengan pajak-pajak lainnya: untuk
tahun pajak yang pada atau setelah tanggal 1 Januari di tahun kalender
berikutnya dari tanggal disampaikannya permberitahuan pengakhiran tersebut.
(b) Di India, berkenaan dengan penghasilan yang
diperoleh dalam tahun pajak pada atau setelah tanggal 1 April di tahun kalender
berikutnya dari tanggal disampaikannya pemberitahuan tersebut.
SEBAGAI BUKTI, yang bertanda
tangan di bawah ini, telah diberi kuasa yang sah, telah menandatangani
Persetuiuan ini.
DIBUAT di New Delhi, tanggal
27 Juli 2012 dalam dua naskah identik masing-masing dalam bahasa Indonesia,
Hindi dan Inggris, ketiga naskah tersebut mempunyai kekuatan hukum yang sama.
Dalam hal terjadi perbedaan penafsiran, maka yang berlaku adalah naskah bahasa
Inggris.

PROTOKOL
Pada saat
penandatanganan Persetujuan hari ini disimpulkan antara Pemerintah Republik
Indonesia dan Pemerintah Republik India untuk penghindaran pajak berganda dan
pencegahan pengelakan pajak yang berhubungan dengan pajak-pajak atas
penghasilan, telah disepakati pada saat penandatanganan Persetujuan bahwa
ketentuan-ketentuan berikut ini akan merupakan bagian yang tak terpisahkan dari
Persetujuan
1. Merujuk pada Pasal 7 ayat 1 (Laba Usaha),
dapat dipahami bahwa laba yang berasal dari penjualan barang-barang atau barang
dagangan dari jenis yang sama atau yang serupa seperti yang dijual, atau dan
kegiatan-kegiatan usaha yang sama atau serupa yang dilakukan melalui bentuk
usaha tetap, dapat dianggap berasal dari bentuk usaha tetap jika terbukti
bahwa:
(i) transaksi ini
dilakukan untuk menghindari pajak di Negara Pihak di mana bentuk usaha tetap
itu berada, dan
(ii) bentuk usaha
tetap dengan cara apapun terlibat dalam transaksi ini.
2. Dapat dipahami bahwa ketentuan-ketentuan
Pasal 11 ayat 1 dan 2 (bunga) dan Pasal 12 (Royalti dan upah jasa teknik) tidak
berlaku dan ketentuan-ketentuan Pasal 7 (Laba Usaha) berlaku apabila
penghasilan tersebut terkait efektif dengan kegiatan usaha sebagaimana dimaksud
pada ayat 1 Protokol ini.
3. Menyimpang dari apapun yang diatur dalam
Persetujuan ini, dapat dipahami bahwa tidak akan ada yang mencegah suatu Negara
Pihak untuk mengenakan laba usaha dari suatu bentuk usaha tetap dari suatu
perusahaan Negara Pihak lainnya dengan tarif pajak yang lebih tinggi daripada
yang dikenakan atas laba usaha suatu perusahaan yang serupa di Negara Pihak
yang disebutkan pertama dan hal ini tidak dapat ditafsirkan sebagai suatu
diskriminasi sehubungan dengan Pasal 25 (Non-diskriminasi) maupun menjadi
bertentangan dengan ketentuan Pasal 7 ayat 3 (Laba Usaha).
4. Sesuai Pasal 7, apabila suatu perseroan
yang merupakan penduduk suatu Negara Pihak memiliki suatu bentuk usaha tetap di
Negara Pihak lainnya, laba yang menjadi milik bentuk usaha tetap tersebut
dikenakan suatu pajak tambahan atau pajak atas laba usaha cabang di Negara
lainnya tersebut sesuai dengan undang-undangnya, tetapi dengan tarif tidak
melebihi 15% (lima belas persen). 
5 Dapat dipahami bahwa bila terdapat
pertentangan dalam penerapan antara ketentuan-ketentuan Persetujuan ini dan ketentuan-ketentuan
kontrak bagi hasil produksi terkait dengan eksploitasi dan produksi minyak dan
gas alam di suatu Negara Pihak yang mengikat Pemerintah atau siapapun yang
diberi wewenang secara sah, maka ketentuan yang berlaku adalah ketentuan yang
disebut belakangan
6. Sehubungan dengan Pasal 27 ayat 2
(pertukaran informasi), dapat dipahami bahwa informasi yang diterima oleh
Negara Pihak dapat digunakan untuk tujuan kepentingan penyelenggaraan
Pemerintah lainnya bila dibolehkan berdasarkan ketentuan perundang-undangan
kedua Negara Pihak dan pejabat yang berwenang dari Negara Pihak Persetujuan
yang menyediakan informasi menyetujui penggunaan hal semacam itu
SEBAGAI BUKTI, yang bertandatangan di bawah ini,
telah diberi kuasa yang sah, telah menandatangani Protokol ini.
DIBUAT di New Delhi, tanggal 27 Juli 2012 dalam dua
naskah identik masing-masing dalam bahasa Indonesia Hindi dan Inggris, ketiga
naskah tersebut mempunyai kekuatan hukum yang sama. Dalam hal terjadi perbedaan
penafsiran, maka yang berlaku adalah naskah bahasa Inggris.
