Konsolidasi Undang-Undang Pajak Pertambahan Nilai


Susunan dalam Satu Naskah Undang-Undang Republik Indonesia Nomor 8 Tahun 1983 tentang Pajak Pertambahan Nilai Barang dan Jasa dan Pajak Penjualan atas Barang Mewah sebagaimana diubah terakhir dengan Undang-Undang Republik Indonesia Nomor 7 Tahun 2021


BAB IV TARIF PAJAK DAN CARA MENGHITUNG PAJAK

Pasal 10 (UU No. 18 Tahun 2000)

(1) Pajak Penjualan Atas Barang Mewah yang terutang dihitung dengan cara mengalikan tarif sebagaimana dimaksud dalam Pasal 8 dengan Dasar Pengenaan Pajak.
(2) Pajak Penjualan Atas Barang Mewah yang sudah dibayar pada waktu perolehan atau impor Barang Kena Pajak Yang Tergolong Mewah, tidak dapat dikreditkan dengan Pajak Pertambahan Nilai maupun Pajak Penjualan Atas Barang Mewah yang dipungut berdasarkan Undang-Undang ini.
(3) Pengusaha Kena Pajak yang mengekspor Barang Kena Pajak Yang Tergolong Mewah dapat meminta kembali Pajak Penjualan Atas Barang Mewah yang telah dibayar pada waktu perolehan Barang Kena Pajak Yang Tergolong Mewah yang diekspor tersebut.

BAB IV TARIF PAJAK DAN CARA MENGHITUNG PAJAK

Penjelasan Pasal 10

Ayat (1)

Cara menghitung Pajak Penjualan Atas Barang Mewah yang terutang adalah dengan mengalikan Harga Jual, Nilai Impor, Nilai Ekspor atau Nilai Lain yang ditetapkan dengan Keputusan Menteri Keuangan dengan tarif pajak sebagaimana ditetapkan dalam Pasal 8.

Ayat (2)

Berbeda dengan Pajak Pertambahan Nilai yang dipungut pada setiap tingkat penyerahan, Pajak Penjualan Atas Barang Mewah hanya dipungut pada tingkat penyerahan oleh Pengusaha Kena Pajak yang menghasilkan Barang Kena Pajak Yang Tergolong Mewah atau atas impor Barang Kena Pajak Yang Tergolong Mewah. Dengan demikian, Pajak Penjualan Atas Barang Mewah bukan merupakan Pajak Masukan sehingga tidak dapat dikreditkan. Oleh karena itu, Pajak Penjualan Atas Barang Mewah dapat ditambahkan ke dalam harga Barang Kena Pajak yang bersangkutan atau dibebankan sebagai biaya sesuai ketentuan perundang-undangan Pajak Penghasilan.

Contoh:

Pengusaha Kena Pajak “A” mengimpor Barang Kena Pajak dengan Nilai Impor Rp5.000.000,00. Barang Kena Pajak tersebut, selain dikenakan Pajak Pertambahan Nilai, misalnya juga dikenakan Pajak Penjualan Atas Barang Mewah dengan tarif 20%.

Dengan demikian, penghitungan Pajak Pertambahan Nilai dan Pajak Penjualan Atas Barang Mewah yang terutang atas impor Barang Kena Pajak tersebut adalah:
- Dasar Pengenaan Pajak = Rp5.000.000,00
- Pajak Pertambahan Nilai :     
10% x Rp5.000.000,00

= Rp   500.000,00
- Pajak Penjualan Atas Barang Mewah :     
20% x Rp5.000.000,00

= Rp1.000.000,00

Kemudian, Pengusaha Kena Pajak “A” menggunakan Barang Kena Pajak tersebut sebagai bagian dari suatu Barang Kena Pajak lain yang atas penyerahannya dikenakan Pajak Pertambahan Nilai 10% dan Pajak Penjualan Atas Barang Mewah 35%. Oleh karena Pajak Penjualan Atas Barang Mewah yang telah dibayar atas Barang Kena Pajak yang diimpor tersebut tidak dapat dikreditkan, maka Pajak Penjualan Atas Barang Mewah sebesar Rp1.000.000,00 dapat ditambahkan ke dalam harga Barang Kena Pajak yang dihasilkan oleh Pengusaha Kena Pajak “A” atau dibebankan sebagai biaya.

Kemudian, Pengusaha Kena Pajak “A” menjual Barang Kena Pajak yang dihasilkannya kepada Pengusaha Kena Pajak “B” dengan Harga Jual Rp50.000.000,00. Maka, penghitungan Pajak Pertambahan Nilai dan Pajak Penjualan Atas Barang Mewah yang terutang adalah:
- Dasar Pengenaan Pajak = Rp50.000.000,00
- Pajak Pertambahan Nilai :     
10% x Rp50.000.000,00

= Rp  5.000.000,00
- Pajak Penjualan Atas Barang Mewah :     
35% x Rp50.000.000,00

= Rp17.500.000,00

Dalam contoh ini, Pengusaha Kena Pajak “A” dapat mengkreditkan Pajak Pertambahan Nilai sebesar Rp500.000,00 di atas terhadap Pajak Pertambahan Nilai sebesar Rp5.000.000,00.
Sedangkan Pajak Penjualan Atas Barang Mewah sebesar Rp1.000.000,00 tidak dapat dikreditkan, baik dengan Pajak Pertambahan Nilai sebesar Rp5.000.000,00 maupun dengan Pajak Penjualan Atas Barang Mewah sebesar Rp17.500.000,00.

Ayat (3)

Pengusaha Kena Pajak yang telah membayar Pajak Penjualan Atas Barang Mewah pada saat perolehan Barang Kena Pajak Yang Tergolong Mewah, sepanjang Pajak Penjualan Atas Barang Mewah tersebut belum dibebankan sebagai biaya, Pengusaha Kena Pajak berhak meminta kembali Pajak Penjualan Atas Barang Mewah yang dibayarnya, apabila Pengusaha Kena Pajak dimaksud telah mengekspor Barang Kena Pajak Yang Tergolong Mewah tersebut.

Contoh :

Pengusaha Kena Pajak "A" membeli mobil dari Agen Tunggal Pemegang Merk seharga Rp100.000.000,00.

Dia membayar Pajak Pertambahan Nilai dan Pajak Penjualan Atas Barang Mewah masing-masing sebesar Rp10.000.000,00 dan Rp35.000.000,00. Apabila mobil tersebut kemudian diekspornya, maka Pengusaha Kena Pajak "A" berhak untuk meminta kembali Pajak Pertambahan Nilai sebesar Rp10.000.000,00 dan Pajak Penjualan Atas Barang Mewah sebesar Rp35.000.000,00 yang telah dibayarnya pada saat membeli mobil tersebut.

CHAPTER IV TAX RATES AND HOW TO CALCULATE TAX

- Value Added Tax :     
10% x IDR 50,000,000.00

= IDR  5,000,000.00
- Sales Tax on Goods Luxury :     
35% x IDR 50,000,000.00

= IDR 17,500,000.00

In this example, “A” Taxable Entrepreneur gets credit Value Added Tax of IDR 500,000.00 above for Value Added Tax of IDR 5,000,000.00.
Meanwhile, Sales Tax on Luxury Goods is IDR 1,000,000.00 cannot be credited, either with Value Added Tax of Rp. 5,000,000.00 or with Sales Tax on Luxury Goods in the amount of Rp. 17,500,000.00.

Paragraph (3)

Taxable Entrepreneurs who have paid Sales Tax on Goods Luxury at the time of acquisition of Taxable Goods Classified as Luxury, as long as Sales Tax on Luxury Goods has not been charged as a fee, a Taxable Entrepreneur has the right to request a return of Tax Sales of Luxury Goods paid for, if the Entrepreneur is Subject to The said Tax has exported Taxable Goods Classified as Luxury it.

Example:

Taxable Entrepreneur "A" buys a car from the Sole Agent of the Brand Holder for IDR 100,000,000.00.
