Pajak Penghasilan dikenakan terhadap Subjek Pajak atas Penghasilan yang diterima atau diperolehnya dalam tahun pajak.

Penjelasan Pasal 1

Undang-Undang ini mengatur pengenaan Pajak Penghasilan terhadap subjek pajak berkenaan dengan penghasilan yang diterima atau diperolehnya dalam tahun pajak. Subjek pajak tersebut dikenai pajak apabila menerima atau memperoleh penghasilan. Subjek pajak yang menerima atau memperoleh penghasilan, dalam Undang-Undang ini disebut Wajib Pajak. Wajib Pajak dikenai pajak atas penghasilan yang diterima atau diperolehnya selama satu tahun pajak atau dapat pula dikenai pajak untuk penghasilan dalam bagian tahun pajak apabila kewajiban pajak subjektifnya dimulai atau berakhir dalam tahun pajak.

Yang dimaksud dengan “tahun pajak” dalam Undang-Undang ini adalah tahun kalender, tetapi Wajib Pajak dapat menggunakan tahun buku yang tidak sama dengan tahun kalender, sepanjang tahun buku tersebut meliputi jangka waktu 12 (dua belas) bulan.

Explanation Article 1

This law regulates the imposition of income tax on subjects taxes in respect of income received or accrued in a tax year. The tax subject is subject to tax when receiving or earn income. Tax subjects who receive or obtain income, in this Law is referred to as a Taxpayer. Taxpayer subject to tax on income received or accrued during one tax year or may also be taxed for income within part of the tax year when the subjective tax liability begins or ends in the tax year.

What is meant by "tax year" in this Act is a calendar year, but taxpayers can use a book year which is not the same as the calendar year, throughout the book year covering a period of 12 (twelve) months.
