BAB V PELUNASAN PAJAK DALAM TAHUN BERJALAN

Pasal 24 (UU No. 36 Tahun 2008)


(1) Pajak yang dibayar atau terutang di luar negeri atas penghasilan dari luar negeri yang diterima atau diperoleh Wajib Pajak dalam negeri boleh dikreditkan terhadap pajak yang terutang berdasarkan Undang-undang ini dalam tahun pajak yang sama.
(2) Besarnya kredit pajak sebagaimana dimaksud pada ayat (1) adalah sebesar pajak penghasilan yang dibayar atau terutang di luar negeri tetapi tidak boleh melebihi penghitungan pajak yang terutang berdasarkan Undang-undang ini.
(3) Dalam menghitung batas jumlah pajak yang boleh dikreditkan, sumber penghasilan ditentukan sebagai berikut :
a. penghasilan dari saham dan sekuritas lainnya serta keuntungan dari pengalihan saham dan sekuritas lainnya adalah negara tempat badan yang menerbitkan saham atau sekuritas tersebut didirikan atau bertempat kedudukan;
b. penghasilan berupa bunga, royalti, dan sewa sehubungan dengan penggunaan harta gerak adalah negara tempat pihak yang membayar atau dibebani bunga, royalti, atau sewa tersebut bertempat kedudukan atau berada;
c. penghasilan berupa sewa sehubungan dengan penggunaan harta tak gerak adalah negara tempat harta tersebut terletak;
d. penghasilan berupa imbalan sehubungan dengan jasa, pekerjaan, dan kegiatan adalah negara tempat pihak yang membayar atau dibebani imbalan tersebut bertempat kedudukan atau berada;
e. penghasilan bentuk usaha tetap adalah negara tempat bentuk usaha tetap tersebut menjalankan usaha atau melakukan kegiatan;
f. penghasilan dari pengalihan sebagian atau seluruh hak penambangan atau tanda turut serta dalam pembiayaan atau permodalan dalam perusahaan pertambangan adalah negara tempat lokasi penambangan berada;
g. keuntungan karena pengalihan harta tetap adalah negara tempat harta tetap berada; dan
h. keuntungan karena pengalihan harta yang menjadi bagian dari suatu bentuk usaha tetap adalah negara tempat bentuk usaha tetap berada.
(4) Penentuan sumber penghasilan selain penghasilan sebagaimana dimaksud pada ayat (3) menggunakan prinsip yang sama dengan prinsip yang dimaksud pada ayat tersebut.
(5) Apabila pajak atas penghasilan dari luar negeri yang dikreditkan ternyata kemudian dikurangkan atau dikembalikan, maka pajak yang terutang menurut Undang-undang ini harus ditambah dengan jumlah tersebut pada tahun pengurangan atau pengembalian itu dilakukan.
(6) Ketentuan mengenai pelaksanaan pengkreditan pajak atas penghasilan dari luar negeri diatur dengan atau berdasarkan Peraturan Menteri Keuangan.

Penjelasan Pasal 24

Pada dasarnya Wajib Pajak dalam negeri terutang pajak atas seluruh penghasilan, termasuk penghasilan yang diterima atau diperoleh dari luar negeri. Untuk meringankan beban pajak ganda yang dapat terjadi karena pengenaan pajak atas penghasilan yang diterima atau diperoleh di luar negeri, ketentuan ini mengatur tentang perhitungan besarnya pajak atas penghasilan yang dibayar atau terutang di luar negeri yang dapat dikreditkan terhadap pajak yang terutang atas seluruh penghasilan Wajib Pajak dalam negeri.

Ayat (1)

Pajak atas penghasilan yang dibayar atau terutang di luar negeri yang dapat dikreditkan terhadap pajak yang terutang di Indonesia hanyalah pajak yang langsung dikenakan atas penghasilan yang diterima atau diperoleh Wajib Pajak.

Contoh:
PT A di Indonesia merupakan pemegang saham tunggal dari Z Inc. di Negara X. Z Inc. tersebut dalam tahun 1995 memperoleh keuntungan sebesar US$100,000.00. Pajak Penghasilan yang berlaku di negara X adalah 48% dan Pajak Dividen adalah 38%. Penghitungan pajak atas dividen tersebut adalah sebagai berikut :

Pajak Penghasilan yang dapat dikreditkan terhadap seluruh Pajak Penghasilan yang terutang atas PT A adalah pajak yang langsung dikenakan atas penghasilan yang diterima atau diperoleh di luar negeri, dalam contoh di atas yaitu jumlah sebesar US$19,760.00.

Pajak Penghasilan (Corporate income tax) atas Z Inc. sebesar US$48,000.00 tidak dapat dikreditkan terhadap Pajak Penghasilan yang terutang atas PT A, karena pajak sebesar US$48,000.00 tersebut tidak dikenakan langsung atas penghasilan yang diterima atau diperoleh PT A dari luar negeri, melainkan pajak yang dikenakan atas keuntungan Z Inc. di negara X.

Ayat (2)

Untuk memberikan perlakuan pemajakan yang sama antara penghasilan yang diterima atau diperoleh dari luar negeri dan penghasilan yang diterima atau diperoleh di Indonesia, maka besarnya pajak yang dibayar atau terutang di luar negeri dapat dikreditkan terhadap pajak yang terutang di Indonesia tetapi tidak boleh melebihi besarnya pajak yang dihitung berdasarkan Undang-undang ini. Cara penghitungan besarnya pajak yang dapat dikreditkan ditetapkan oleh Menteri Keuangan berdasarkan wewenang sebagaimana diatur pada ayat (6).

Ayat (3) dan (4)

Dalam perhitungan kredit pajak atas penghasilan yang dibayar atau terutang di luar negeri yang dapat dikreditkan terhadap pajak yang terutang menurut Undang-Undang ini, penentuan sumber penghasilan menjadi sangat penting. Selanjutnya, ketentuan ini mengatur tentang penentuan sumber penghasilan untuk memperhitungkan kredit pajak luar negeri tersebut.

Mengingat Undang-Undang ini menganut pengertian penghasilan yang luas, maka sesuai dengan ketentuan pada ayat (4) penentuan sumber dari penghasilan selain yang tersebut pada ayat (3) dipergunakan prinsip yang sama dengan prinsip sebagaimana dimaksud pada ayat (3) tersebut, misalnya A sebagai Wajib Pajak dalam negeri memiliki sebuah rumah di Singapura dan dalam tahun 1995 rumah tersebut dijual. Keuntungan yang diperoleh dari penjualan rumah tersebut merupakan penghasilan yang bersumber di Singapura karena rumah tersebut terletak di Singapura.

Ayat (5)

Apabila terjadi pengurangan atau pengembalian pajak atas penghasilan yang dibayar di luar negeri, sehingga besarnya pajak yang dapat dikreditkan di Indonesia menjadi lebih kecil dari besarnya perhitungan semula, maka selisihnya ditambahkan pada Pajak Penghasilan yang terutang menurut Undang-undang ini. Misalnya, dalam tahun 1996, Wajib Pajak mendapat pengurangan pajak atas penghasilan luar negeri tahun pajak 1995 sebesar Rp5.000.000,00 yang semula telah termasuk dalam jumlah pajak yang dikreditkan terhadap pajak yang terutang untuk tahun pajak 1995, maka jumlah sebesar Rp5.000.000,00 tersebut ditambahkan pada Pajak Penghasilan yang terutang dalam tahun pajak 1996.

Consolidation of Income Tax Act


Arrangement in One Text of the Law of the Republic of Indonesia Number 7 of 1983 concerning Income Tax as lastly amended by the Law of the Republic of Indonesia Number 11 of 2020 concerning Job Creation


CHAPTER V PAYMENT OF TAXES IN THE CURRENT YEAR

Article 24 (Law No. 36 of 2008)


(1) Tax paid or owed abroad on income from abroad received or obtained by the Compulsory Domestic taxes may be credited against the tax payable based on this Law in the same tax year.
(2) Size tax credit as referred to in paragraph (1) is the amount of income tax paid or payable in abroad but may not exceed the tax calculation owed under this Law.
(3) In calculate the amount of tax that may be allowed credited, the source of income is determined as follows:
a. income from stock and other securities and gains from the transfer of shares and another security is the country where the body that issued the shares is or the securities are established or domiciled;
b. income flower, royalties, and rent in connection with the use of movable property is the country in which the party paying or being charged interest, royalties, or the lease is domiciled or located;
c. income form of rent in connection with the use of immovable property is the country where the property is located is located;
d. income form compensation in connection with services, work, and activities is the state the place where the party paying or being charged the fee is located position or being;
e. income form of business permanent establishment is the country in which the permanent establishment operates business or carry out activities;
f. income from transfer of part or all of the mining rights or participation sign in financing or capital in mining companies is the country where the mining site is located;
g. advantage Because transfer of fixed assets is the country where the fixed assets are located; and
h. advantage Because transfer of assets that are part of a permanent establishment is the country in which the permanent establishment is situated.
(4) Determination sources of income other than income as referred to in paragraph (3) uses the same principle as the principle referred to in this paragraph.
(5) If tax on income from abroad credited turns out to be later deducted or refunded, then tax payable according to this Law must be added with the amount in the year the reduction or refund is made.
(6) Conditions regarding implementationn tax credit on income from abroad is regulated by or based on Minister of Finance Regulation.

Explanation Article 24

Basically, domestic taxpayers are owed tax on the whole income, including income received or earned from overseas. To lighten the burden of double taxation that can occur due to the imposition of tax on income received or accrued in abroad, this provision regulates the calculation of the amount of tax on income paid or payable abroad that can credited against the tax payable on the entire income of the Compulsory Domestic tax.
Paragraph (1)

Taxes on income paid or payable abroad can be credited against taxes payable in Indonesia only tax directly imposed on income received or obtained by the taxpayer.
Example:
PT A in Indonesia is the sole shareholder of Z Inc. in Country X.Z Inc. in 1995 made a profit US$100,000.00. Income Tax applicable in country X is 48% and Dividend Tax is 38%. Top tax calculation The dividends are as follows:

Income Tax that can be credited against all Taxes Income payable on PT A is direct tax imposed on income received or earned abroad, in the example above that would be US$19,760.00.

Corporate income tax on Z Inc. as big US$48,000.00 is non-creditable against Income Tax which payable to PT A, due to tax of US$48,000.00 is not directly imposed on the income received or accrued by PT A from abroad, but taxes levied on the profits of Z Inc. in country X.

Paragraph (2)

To provide equal tax treatment between income earners received or obtained from abroad and income received or obtained in Indonesia, then the amount of tax paid or payable abroad can be credited against the tax payable in Indonesia but may not exceed the amount of tax calculated based on this Law. How to calculate the amount of tax can be credited determined by the Minister of Finance based on authority as regulated in paragraph (6).

Paragraphs (3) and (4)

In calculating the tax credit on income paid or payable abroad that can be credited against taxes payable according to this Law, the determination of the source of income be very important. Furthermore, this provision regulates about determination of sources of income to account for outside tax credits the country.

Considering that this Law adheres to a broad definition of income, then in accordance with the provisions in paragraph (4) determination of the source of income other than what is stated in paragraph (3) is usedprinciple the same principle as referred to in paragraph (3), for example A as a resident Taxpayer owns a house in Singapore and in 1995 the house was sold. which advantage obtained from the sale of the house is income sourced in Singapore because the house is located in Singapore.

Paragraph (5)

If there is a deduction or refund of tax on income paid abroad, so the amount of tax that can be credited in Indonesia to be smaller than the amount of calculation originally, then the difference is added to the Income Tax which owed under this law. For example, in 1996, Compulsory Taxes get a tax deduction on foreign income year 1995 tax of IDR 5,000,000.00 which was originally included in the the amount of tax credited against taxes payable for the year 1995 tax, then the amount of Rp. 5,000,000.00 is added on Income Tax payable in the 1996 tax year.
