Konsolidasi Undang-Undang Pajak Penghasilan


Susunan dalam Satu Naskah dari Undang-Undang Republik Indonesia Nomor 7 Tahun 1983 tentang Pajak Penghasilan sebagaimana diubah terakhir dengan Undang-Undang Republik Indonesia Nomor 7 Tahun 2021 Tentang Harmonisasi Peraturan Perpajakan


BAB II SUBJEK PAJAK

Pasal 3 (UU No. 36 Tahun 2008)


(1) Yang tidak termasuk subjek pajak sebagaimana dimaksud dalam Pasal 2 adalah :
a. kantor perwakilan negara asing;
b. pejabat-pejabat perwakilan diplomatik dan konsulat atau pejabat-pejabat lain dari negara asing dan orang-orang yang diperbantukan kepada mereka yang bekerja pada dan bertempat tinggal bersama-sama mereka dengan syarat bukan warga negara Indonesia dan di Indonesia tidak menerima atau memperoleh penghasilan di luar jabatan atau pekerjaannya tersebut serta negara bersangkutan memberikan perlakuan timbal balik;
c. organisasi-organisasi internasional dengan syarat :
1. Indonesia menjadi anggota organisasi tersebut; dan
2. tidak menjalankan usaha atau kegiatan lain untuk memperoleh penghasilan dari Indonesia selain memberikan pinjaman kepada pemerintah yang dananya berasal dari iuran para anggota;
d. pejabat-pejabat perwakilan organisasi internasional sebagaimana dimaksud pada huruf c, dengan syarat bukan warga negara Indonesia dan tidak menjalankan usaha, kegiatan, atau pekerjaan lain untuk memperoleh penghasilan dari Indonesia.
(2) Organisasi internasional yang tidak termasuk subjek pajak sebagaimana dimaksud pada ayat (1) huruf c ditetapkan dengan Keputusan Menteri Keuangan.

Ayat (1)

Sesuai dengan kelaziman internasional, kantor perwakilan negara asing beserta pejabat-pejabat perwakilan diplomatik, konsulat dan pejabat-pejabat lainnya, dikecualikan sebagai subjek pajak di tempat mereka mewakili negaranya.

Pengecualian sebagai subjek pajak bagi pejabat-pejabat tersebut tidak berlaku apabila mereka memperoleh penghasilan lain di luar jabatannya atau mereka adalah Warga Negara Indonesia.
Dengan demikian apabila pejabat perwakilan suatu negara asing memperoleh penghasilan lain di Indonesia di luar jabatan atau pekerjaannya tersebut, maka ia termasuk subjek pajak yang dapat dikenai pajak atas penghasilan lain tersebut.

Arrangement in One Text of the Law of the Republic of Indonesia Number 7 of 1983 concerning Income Tax as lastly amended by the Law of the Republic of Indonesia Number 11 of 2020 concerning Job Creation


CHAPTER II TAX SUBJECT

Article 3 (Law No. 36 of 2008)


(1) Which excluding tax subjects as referred to in Article 2 are:
a. office representatives of foreign countries;
b. officials diplomatic representatives and consulates or other officials from foreign countries and persons seconded to those who work for and live with them on condition not an Indonesian citizen and in Indonesia do not accept or earn income outside the position or work as well the country concerned provides reciprocal treatment;
c. organizations international with the following conditions:
1. Indonesia become a member of the organization; and
2. no carry out business or other activities to obtain income from In addition to providing loans to the government, Indonesia has funds comes from membership dues;
d. officials representatives of international organizations as referred to in letter c, provided that he is not an Indonesian citizen and does not run a business, activities, or other work to obtain income from Indonesia.
(2) Organization international not included the tax subject as referred to in paragraph (1) letter c is determined with the Decree of the Minister of Finance.

Paragraph (1)

In accordance with international custom, representative offices of foreign countries along with diplomatic representatives, consulates and officials other officials, are exempted as local tax subjects they represent their country.

There are no exceptions as tax subjects for these officials applies if they earn other income outside of their position or they are Indonesian citizens.
Thus if the official representative of a foreign country earn other income in Indonesia outside the position or his work, then he is included as a tax subject that can be subject to tax tax on other income.
